On November, 20; 2012, the City Council authorized the filing of a grant application for the
Rubberized Pavement Grant Prooram throueh the Department of Resources, Recycline and
Recovery (CalRecycle). (Attachment 1) The grant program is designed to encourage activities
that promote reducin� the number of �i�aste tires eoing to landfills for disposal and to promote
markets for rubberized pavement products derived from one-hundred percent (100%) recti�cled
Califomia-eenerated ���aste tires.
The Cin� had applied for Rubberized Chip Seal erant fundine for pavement projects within the
City. This agenda statement is inte�ded to inform Council that the grant application �vas
approved and the City has received funding from CalRecycle in the amount of S2�0;000. This

resolution amends the Fiscal Year 2013-14 CIP Budget by appropriating the grant funds to
existine Capital Improvement Project STL397 (Pavement Minor Rehabilitation FY13-14), and
authorizes the Director of Public Works or his designee the power to execute in the name of the
Ciry of Chula Vista all grant documents, including but not limited to, applications, agreements;
amendments and requests for payments.
ENVIROND'IENTAL REVIE�'1'
The Development Sernices Director has reviewed the proposed activity consisting of acceptance
of grant funds and filing of the appropriate documentation, for compliance with the California
Environmental Quality Act (CEQA) and has determined that the activity is not a 'Project" as
defined under Section 1�378 of the State CEQA Guidelines because the proposal consists of a
eovernmental fiscal activity which does not involve any commitment to any specific project,
which may result in a potentially significant impact on the environment. Therefore, pursuant to
Section 15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA review.
Although environmental review is not required at this time, once the scope of individual projects
to be funded have been defined, environmental revie«� will be required for each project and the
appropriate environmental determination will be made.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
The Califomia Department of Resources Recycling and Recovery (CalRecycle), formerly kno�m
as the California lntegrated Waste Management Board (CIWMB), provides the Rubberized
Pavement Grant Program Co promote markets for recyded-content surfacing products derived
from waste tires generated in Califomia and decrease the adverse environmenfal impacts created
by unlawful disposal and stockpiling of waste tires.
The funding of project(s) is based on the amount of RAC material used and number of previous
CalRecycle RACX/Pavement grants received. The maximum grant award for RAC and/or Chip
Seal project(s) is $250;000.
All projects are subject to the following requirements:
• One hundred percent (100%) California-generated waste tires must be used in the rubber
portion of the project(s).
• The project(s) must be located in California.
• Reimbursement ���ill not exceed the amount on the Grant Agreement Cover Sheet
(CalRecycle 110).
• Construction of the RAC portion of any project must commence on or after the date indicated
in the Notice to Proceed and be completed by April 1, 2016.

• The binder material must contain a minimum of 300 pounds (equivalent to 1� percent by
ti�eiQht) of the tire-derived crumb rubber per ton of rubberized binder.
• RAC Grant Proiect: Project(s) must use a minimum of 3;�00 tons of RAC.
• Chip Seal Grant Proiecr. Project(s) must use a minimum of 3�,000 squaze yards of RAC.
The erant application was orieinall�� for the Fiscal Year 2012-13 Rubber Chip Seal proeram on
collector and arterial streets. On A4azch 4, 2013; CalRecycle staff stated that the funds for Fiscal
Yeaz 2012-li had been exhausted but asked the Cin� whether we would be interested in
obtainine fundine in Fiscal Yeaz 2013-14. Staff agreed to this ofFer. On August 12; 2013, staff
«�as notified that the Cin� of Chula Vista had been awarded a erant for �250,000 for Fiscal Yeaz
2013-14.
STL397 is an existina pavement-related project in the Gitys Capital Improvement Program that
can be used to construct a rubberized chip seal project In an effort to expend the arant funds
accordin¢ to the grant guidelines; staff is recommending appropriating the erant funds to this
project for expenditure. Staff«�11 evaluate the best locations for use of the rubberized chip seal;
��hich will generallv be Collector or Arterial streets. The street locations will be provided for
Counci] approval ��hen the construction contract will be provided for Council approval.
DECISION AZAKER CONFLICT
Staff has revie�i�ed the decision contemplated by this action and has determined that it is not site
specific and consequently the �00 foot rule found in Califomia Code of Rewlations section
18704.2(a)(1) is not applicable to this decision. Staff is not independendy aware; nor has staff
been informed by any Cit}� Councilmember, of any other fact that may constirute a basis for a
decision maker conflict of interest in this matter.
CURRENT 1'EAR FISCAL I14PACT
There is no direct impact to the General Fund associated with this action. _
ONGOING FISCAL IMPACT �
There will be a future fiscal impact to the Proposition 42 fund «�hich �vill be addressed further
when a construction contract is a���azded.

AMENDMENTS AND REQUESTS FOR PAYMENTS
NECESSARY TO SECURE GRANT FiJi�'DS
WHEREAS, Public Resources Code sections 40000 et seq. authorize the Department of
Resources Recycling and Recovery (CalRecycie), to administcr various Grant Programs (grants)
in furtherance of the state of Califomia's (State) efforts to reduce, recycle and reuse solid waste
generated in the State thereby preserving landfill capacity and protecting public health and safety
and the environment; and
WHEREAS, in furtherance of this authority Ca]Recycle is required to establish
procedures goveming the application, awazding, and management of the grants; and
WHEREAS, CalKecycle grant application procedures require among other things, an
applicant's governing body to declaze by resolution certain authorizations related to the
administration of CalRecycle grants.
NOW, THEREFORE, BG IT RESOLVED that the City Council of the City of Chula
Vista does hereby authorize the submittal of application(s) to CalRecycle for all grants for which
the Ciry of Chula Vista is eligible.
BE IT FURTHER RESOLVED that the Director of Public Works, or his designee is
hereby authorized and empowered to execute in the name of the City of Chula Vista all grant
documents, including but not limited to, applications, agreements, amendments and requests for
payment, necessazy to secure grant funds; and
BE IT FURTHER RESOLVED that these authorizations aze effective for five (5) yeazs
from the date of adoption of this resolution.

WHEREAS; staff recommends that the City Council accept the grant funds for
eapenditure in the Capital Impro��ement Program, appropriate tl�e grant funds to the above-
mentioned project for expenditure, amend the Fiscal Year 2013-14 CIP Budget; and
I�rOW, THEREFORE, BE 1T IZESOLVED that the City Council of the City of Chula
Vista does hereby accept grant funds in ihe amount of$250,000 for Fiscal Year 2013-14 from
the Department of Resources, Recycling and Recovery (CalRecycle).
BE IT FURTHER RESOLVED that the Fiscal Year 20li-14 CIP Budget be amended b�
appropriating said grant funds to existing Capital Improvement Project STL397 "Pavement
Minor Rehabili[ation FY 13-14"; and
BE ]T FURTHER RESOLVED that the Director of Public Works, or his designee is
hereby authorized and has the poN�er to execute in the name of the Cit�� of Chula Vista all arant
documents, including but not limited to, applications, agreements, ainendments and requests for .
