DIEGO I��IFIED PORT DISTeICT AND RE�UtSTI\�G CEP.T�IN STUDIES 3Y THE
BG1P.D OF SUPEP,VISORS

WHEREAS , a certain bi � l entitled Senat¢ Bill No. 41 , r¢ lative
to the establishment of a San �iego Unified Port District has been
passed by the legislature in th¢ 1962 first ¢xtraordinary session ,
� and �
1�ME2EAS� the City Counci.l of th¢ City of Chula Vista believes
that ther¢ is not s�fiicient information available in connectien
viith the problem of the establishment of a port district , and
WHEREAS, the City Council of the City of Chula Vista reaffirms
its policy and desir¢ to cooperate erith the Stat ¢ L¢gislature, and
, the other legislative bodies involved in establishing a proper
San Diego Port Authority� ,
f�'O��/, THEREFCRE, BE IT RESOLVED as fol lows :
I . That the "Council of th¢ City of Chula .Vista hereby
approves and authorizes the filing of a resolution oi cons¢nt calling
for the formation of the district viith the Board of S�pervisors
upon the follo�ving conditions :
fa ) That the Board of Supervisors conduct a study to •
determin¢ :vhat aress of the county other than the fiv¢ (S) cities
contiguous to the bay shou.ld be included in a San Diego Unified Port
District fincluding incorporat¢d areas as v�¢ II as unincorporated areasl .
( bl That the Board of Suoervisors conduct a financial
study relative to the pr'esent status of port facilitfes , such study
to include a cbmplet¢ report upon all 'outstanding bonded indebtedness
relative to harbor and bay improvemcnts . Such r¢ports should state
how such indebtedness is to bz retired, vrhether from.taxes or some
II " "' "particular revenu¢, or otherv� ise. Such report should also indicate
vrhat the present revenues of bay and port improvements are, it¢mized —

as to the particular imorovements , and also the present op¢rating
� expenses of all harbor op¢rations and th¢ actual tax rat¢, and taxes
collected �vhich are used in connection with the harbor operations .
Icl That the resuits of th¢ foregoing studies b¢ made
' available to the int2rest¢d parti ¢s and to the public within a
reasonable tim¢.
2. That the City Administrator be direct¢d to submit a copy
� of this resolution and a communication to th¢ Board of Supervisors
requesting that the foregoing studies b¢ made and further inviting
the attention of the Board of Supervisors to the fact that the present
' law as passed by the legislature provides that only the five ( 51
� contiguous cities and unincorporated ar¢as which "are economically
linked to the development and operation of the Bay of San Diego" can
be included in the district . That no other incorporated area in
the County of San Diego can be included by the terms of th¢ present
bill . That although the bill provides that an unincorporated area
may be included in th¢ district , the bill does not provide for any
vote by the people of such unincorporated area upon its inclusion�
nor does the bill provide for any repr¢sentation from the Board of
Supervisors or from such unincorporat¢d territory on th¢ 3oard of
Port Commfssioners .
That vihile the Board of Supervisors makes the actual levy,
the amount of money to be raised is d¢termined by the Board of
Harbor Commissioners and th¢ act of I ¢vying a tax to raise this
amount becomes merely ministerial , '
