HomeMy WebLinkAboutReso 1962-2807 Resolution No. 2807 RESOLUTION No. 2807 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHUTA VISTA, CALIFORNIA, RECITING TNE FACT OF TtiE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF CHUTA VISTA ON THE lOth DAY OF APRIL, 1962 , DECIARING TAE RESULT THEREOF AND SUCH OTHER HATTERS AS ARE PROVIDED BY IAW IiNEREAS, a regular general municipal election vas held and conducted in the City of Chula Vista, County of San Diego, State of California on Tuesday the lOth day of April, 1962, as required by law; and WHEREAS, notice of said election vas duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers vere appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvasaed and the returns made and declared in time, form and manner as required by Che provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, on the 17th day of April, 1962 , at the hour of 7:00 P.M. the City Council duly assembled at its usual place of ineeting and has canvassed the returns of said election and as a result of vhich, the City Council finds that the n�ber of votes cast and the names of the persons voted for, the office each peraon vas voted for, and other matters required by lav to be as stated hereinafter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHUTA VISTA, CALIPORNIA, DOES RESOLVE AS FOLLOWS: ) Section 1. That there vere 49' voting precincts established for the purpose of holding said election consisting of coneolidations of the regular election precincts in the City of Chula Viata and Chula Vista City School District as established for the holding of state and county elections. Section 2. That said regular general municipal election vas held for the purpose of electing the folloving officers of said City and City School District as required by lavs relating to general law cities in the State of California,to-vit: ltro Members of the City Council of said City for the full term of four years; 'ltao Members of the Board of Education of the Chula Vista City 6chool District for the full term of four years; -1- � Section 3. That at said regular general municipal election, the fo11oW- ing measures were submitted to the electors of said City, to-vit: Proposition A. Amend Article VIII Section 803-5 of the Charter of the City of Chula Vista. This amendment permits a probationary period to be extended to one year as established by the Civil Service Co�ission. Proposition B. Amend Article VI Section 615 of the Charter of the City of Chula Vista. This amendment provides for a Harbor Commission consisting of not less than 5 and not more than 7 members appointed by the City Council. The Harbor Co�isaion shall deal with matters pertaining to jurisdiction,. supervision, management and control of San Diego Bay within jurisdictian of the City. All revenues derived from the tidelands are to be used exclusively for improving the harbor and tide- lands and maintenance and operation of a Harbor Department. The Harbor Co�iasion may recommend leasing of tidelands and must refer all matters of planning and zoning to the Planning Commission for recommendation before final action by the Harbor Commission. Proposition C. Amend Article III, Section 302 of the Charter of the City of Chula Vista. This amendment increases t6e out-of-pocket expendi- tures and costs of City Councilmen from $25.00 to $50.00, and provides that this s� may be increased or decreased by a majority of the voters at any general or special election. Proposition D. Amend Article VIII Section 805 (b) of the Charter of the City of Chula Vista. This amendment extends the temporary appointments by � a head of a department from three months to six months and removes the limitation of a three months' maxi- mimm aggregate period of service as a temporary appointee in any one fiacal year. Section 4. That the whole ni�ber of votes cast in said City (except absent voter ballots) vas 6�23 That the vhole n�ber of absent voter ballots cast in said City vas 19 , making a total of 6342 votes cast in said City. Section 5. That the names of persons voted for at said election for Member of the City Council of said City are as follows: Robert R. McAllister Standlee HcHains Tltat the names of persons voted for at said election for Member of the Board of Education of the Chula Vista City School District are as follows: W. Vaughan Benson Wilson R. Seacord -2- Section 3. (Cont'd) : That the measures voted upon at said election are as follovs: Proposition A. That City Council does declare and determine that: Robert R. McAllister vas elected as Member of the City Council of said City for the full term of four years; Standlee McMains was elected as Member of the City Council of said City for the full term of four years; W. Vaughan Benson vas elected a Hember of the Board of Education for the Chula Vista City School Diatrict for the full term of four years; Wilson R. Seacord vas elected a Member of the Board of Education for the Chula Vista City School District for the full term of four years; -3- Section.6 (Cont'd) That as a reault of said election, a majority of the qualified voters voting on said propositions relating to Charter changes did vote in favor thereof, and that said propositions carried, and shall be deemed adopted and ratified. Section 7. The City Clerk shall enter on the recorda of the City Council of said City, a statement of the result of said election showing: (1) �z) (3) (4) (5) (6) Section 8. That the City Clerk shall iffiediately make and, upon compliance by the persons elected with the provisions of Section 4533 and Section 4536 of the Elections Code of the State of California, ahall deliver to each of such peraons so elected a certificate of election signed by him and duly authenticated; that he shall also administer to each person elected the oath of office prescribed in the State Constitution of the State of California, and shall have them subscribe thereto and file the same in his office. He shall also require from each of such respective persons so elected, the required loyalty oath and file the same in his office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to �rhich they have been elected. Section 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedinga of the City Council of, said City, in the Hinutes of the meeting at which the same is passed and adopted.
