On motion of Councilman SMTTN , seconded by
Councilman McMAINS , the follasving resolution is adopted:
WHEREAS, thQ Spring Valley Sanita4ion District (hereinafter
referred to as thE Sanitation District) is a Disfiricic formed
pussuant, to the County Sanitation District Act (Sections 4700, .
et seq. , Hea2th and Safety Codo) and located in Spring Valley and
adjacent areas easterly of the City of National City ancl the Git.y
of San Diego; and
WHEREAS, the 5an3tation District proposes to cons4ruct an
outfall `sewes line, inclvding manholes, metoring stations and a
puraping station (t,ereinafter referred to as th� Outfall Semer) .
extanding froa� Spring Valley to a point in the vicinity of
Montgomery Freeway �vhere i4 will be connected to the hietrapolifian
3awerage System to be constructed by the Gity of San Diego, all
as shown on the dra�viqg entitled "Enaineering Division, D2partment.
of Public 19orks, County of San Diego, Spring Valley Sanitation
Distr.ict Outfall Sewer", dated btay 16, 1961, a copy of .rrhich is on .
� file with �he City of Chula Vista. and proposes ta canstruct a
temporary extension of said outfall from said point in the vicinity.

WHEREAS. said Outfall S2tiver will be located within easem�nts
and rights of way and within public streets, all as shawn on said
drawing; anc!
YYHEREAS. a portfon of said Gu�fall Sewer will be losated within
the incorpora2ed area of the City of Chula Vista as said area no�+
exists and a portion of said Outfal.l Sewar and the temporary
extension of said Outfail may be located within tarritory hereafter
annexed to the City of Chula Vista; and

iVHEREAS; the Sanitation Distric� has requested th:s City Council
to consent 2o the construc�ionp operation and maintenanca . o£ said
Qutfall Sewer and the temporary ektens;on thereof; and
WHEREAS; .the City o£ Chula Vista has contracted v�ith the City
of San Diego to acqui�e capacity rights in the N�etropolitan Sewerage
5ystem whfch would oermit Chula Vista to discharge 26;20 million
gallons pe= day into the said h:etropoli4an Seweaage System, which
capaeify iights are being acquired by the City of Chula Vista to sesve
the territo�y within .the City of Chula Vista and additional area§
which may 6e annexed to ghe City of Ghula Vista in the future, in-
cluding �hat portion bf �he Sweetv:aCer Rivex drainage 6asin designated
as Area Two on base map showing "sewerage study area ana study iones
contairied iri a report on collection, trea�ment and disposal of sewage
and industTial waste; Cnu�a Vista; Caiifornia, da�ed Apiil 15, 1959,
prepared by Engineeiing Science; Znce , a copy of which is on filo in
the office of the Clerk of the City of Chula Vista; and
��HEREASo. inasmuch a"s the City of Chula Vista is acquiring such
capacity righ4s in the tl,e�ropolitan Sewerage Syst@m to serve said
portiori of the S�eetwater River drainage basin, it desires to be
assured thet the Outfall SPweP ��fll no� be used to serve svch portion
of the Stiveetivater River drainage 6asin unless �uch portion so served
has been artnexed by the City of Ghula Visfa os has becoine a pait of
some municipal corporation, publie agency oi district tha� has
acquirsd. eapecity rights in the Me�sopoli�an Setieexage System £rom the
City of Gfivla Vista; and
WHEFtEASo it is Pzoposad that Outfall Sews� be canstructed to a
size sufficient to psovide capacity for ttie territory wi�hin 4he .

Reservoir; including the portion 2hereof �hat ultimafely may be
anriexed to the City of Chu1a Vista; and
PrHEREAS. at somt� futu_*e date 'tite Cit�� of Chula Vista may acGuire
from the Senita4ioa Distric� the iight to utilize capacity in the
Outfall Sewer to sdrve ter,-_itory in the Sweetwater River drainage
basin .arid �he City of Chula Vista; and

sufffcient capacity rights therein to serve territory Iying north

to be annexed to the City of San Diego; and
WHEREA`,, .it appears desirable and in the best. interests of the
public that. this City. Council consent to such construction and
operation so .that territory within. the Sanitatfon Di.sirict and other
areas :ributory.,to said Outfall may be served.._ NOY�. THEREFORE
BE IT RESOLVED by �he City Council of the City of Chula Vista
as follows:
1. Th'a't' the City Council of the Gity of Chula. Visfa hereby
consents to the construction, operation and maintenance by the Spring
Va11ey Sanitefion Dis�rict of the 0utfa1l Sewer es shourn on the
aforesaid dra4+ing dated h:ay 16, 196I, and th� constri�ction, operation
and maintenance by said District of a temposasy extension from the
westerly end of said Outfell Sewas toward tha Bay of Sac� Diege pending
the completion of the hietiropolitan Sewerage Systema
2. That the foregoing consent is given subject 4o the following
conditionsc` - t;
(a) That Spring Vailey Sanitation District is authorized to
coestii�ct-�said Outfall Sewer viithin t6e public streets in the
incorpora�ed terri2oiy of the City of Chula Viste. provided tha4
said .0utfall Sewex. including manholes and appuitenances, shall
ba constiucted end mainteined in accordance with such reasonable
requ!re�ients and regulations as may be rnposed by the City
Enginees of the Ci'ty of Chvla Vista to psotect sald public
streets and the traveling publfc.
(b) .:That Spring Velley Sanita2ion District shall. not permit,
the_Outfall Sewer to,.,be .used to serve the asea witliin the
Stiveetweter River dsainage basin designated as . Area .Two on. base �
, map showing sewerage stvdy asea . and study , zones contained in a
report on collection, trea4men� and disposa2 of .sewage and
indu§trial waste, Chula Vista, California, dated April 15. 1959.
