Home My WebLink AboutReso 1961-2718' . . � , � . t . � RESOLUTION N0. 2718 � RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING AND DIRECTING THE FILING AND PROSECUTION OF LEGAL ACTION TO CONDEMN CERTAIN LANDS AND RIGHTS OF WAY AND EASEMENTS ON BEHALF OF TEIE CITY OF CfiULA VISTA WHEREAS, the City of Chula Vista has made plans for , and entered into a contract to construct a trunk sewer line to be known as Telegraph Canyon Sewer , and WHEREAS, it is essential to the carrying out of such plans and to the construction of said sewer that certain property be obtained by said city for sewer easement purposes , and WHEREAS said property described on Exhibit "A" , a copy of which is attached hereto and incorporated herein by this reference thereto as though here set forth in full , cannot be obtained without recourse to legal proceedings and it is necessary that said easements and rights of way be secured without delay so that work on said street may proceed , and WHEREAS said sewer easements and rights of way will be located in a new road alignment known as Telegraph Canyon Road, which said roadway will be established by the County of San Diego , and will necessarily have to be conde�ed by the County of San Diego , and WHEREAS said County of San Diego will not acquire such roadway and appurtenant rights thereto in time to avoid delay to the City of Chula Vista and its plans for said Telegraph Sewer , NOW, THER.EFORE , BE IT RESOLVED that JAMES S. DUBERG, City Attorney for the City of Chula Vista be and he is hereby authorized and directed to forthwith institute legal action in the � Superior Court of the State of California in and for the County of San Diego , for the purpose of acquiring by condeumation , or other- wise , property for the purpose of laying out , excavating , operating of , repairing a trunk sewer line , laterals , easements and rights of way for said sewer lines , excavation and embankment , through, under -1- over and across the property set forth in Exhibit "A" incorporated herein by this reference thereto as though here set forth in full . Said property is described on Exhibit "A" attached hereto as Parcel 6 , which is a portion of the Southwest Quarter of the Northwest Quarter of Quarter Section 41 of the Rancho de la Nacion , all located in the County of San Diego , State of California , and outside of the City of Chula Vista. That the City Administrator is hereby authorized and empowered to employ such appraisers as may be necessary and proper to appraise value of the property being taken and to testify in any trial as required, and the council further finds that the use for which the property is to be taken is a public use and that said property is necessary to the proposed public use , and further finds that the property is located in the manner which will be most compatible with the greatest possible good and least private injury.
