Two Fiscal Agent (FA) Program Assistants aze requested to be added to the authorized
count of the Police Grant Fund to support the San Diego La~v Enforcement Coordination
Center (SDLECC). These positions are fully reimbursed by grant funds; along with a 4%
administrative fee for acting as the fiscal agent.
ENVIRO\'>\IENTAL REVIER'
This proposed activity has been reviewed for compliance with the California
Environmental Quality Act (CEQA) and it has been determined that the activity is not a
"Project" as defined under Section 15378 ofthe State CEQA Guidelines because it will not
result in a physical change in the environment. therefore; pursuant to Section 15060(c)(3)
of the State CEQA Guidelines, the activity is not subject to CEQA. Thus. no
environmental review is necessary.

DISCUSSION
The Police Department acts as the fiscal agent for various law enforcement programs
which are funded through various State and Federal agencies. As the fiscal agent, the
Police Department hires and provides salary and benefits for positions which are normally
considered separate from existing City staffmg. These positions are designated as "FA"
(Fiscal Agent) in the title description.
Two FA Program Assistants are requested to be added to the authorized count of the Police
Grant Fund to support the San Diego Law Enforcement Coordination Center (SDLECC).
The SDLECC serves as the regional intelligence fusion center for San Diego and Imperial
counties. Fusion Centers aze focal points for the receipt, analysis, gathering, and sharing
of threat-related information between the federal government and state, local, tribal, and
private sector partners. These two new positions are fully reimbursed by Homeland
Security Grant Program (HSGP) funds, along with"a 4% administrative fee for acting as
the fiscal agent.
FA Program Assistant
The FA Program Assistant is an "at will" position dependent on year-to-year federal grant
funding. The position primazily provides support to the San Diego Law Enforcement
Coordination Center in the azeas of human resources, travel, training, purchasing,
inventory, facility management, and other types of support functions. The position teams,
applies and administers multiple administrative systems and processes used in the Center.
The FA Program Assistant maintains administrative records, explains policies,
independently resoh~es problems whenever feasible, and proactively assists in the logistical
support operation of the Center. The position works under general supervision with a
degree of creativity and latitude required.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is
not site specific and consequently the 500-foot rule found in California Code of
Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not
independently aware, nor has staff been informed by any City Councilmember, of any
other fact that may constitute a basis far a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
Approval of Resolution A will result in the amendment of the compensation schedule and
classification plan to add the classification of FA Program Assistant. This new
classification is an at-will position and will be eliminated if grant funding ends. The FA
Program Assistant will be assigned to the Confidential (CONF) group. The E-Step bi-
weekly salary for this position will be 51,870.01.

Approval of Resolution B will result in the appropriation of 5125,122 to the personnel
services category of the Police Grant Fund budeet for the addition of two FA Program
Assistants to the authorized position count of the Police Grant Fund. The Department
anticipates filling these positions in September. These personnel costs aze fully reimbursed
by homeland security Brant funds; and the City receives a 4% administrative fee for acting
as the fiscal intermediary for these positions. Because ofthe 4% administrative fee; there
is a positive impact of 55;005 to the General Fund this fiscal yeaz.
Approval of the Ordinance will amend Chula Vista Municipal Code 2.05.010 to reflect the
addition of FA Pro¢ram Assistant.
O~GOL~'G FISCAL IDIPACT
The ongoing annual cost for these positions is approximately S153;000. The personnel
costs are fully reimbursed by homeland security grant funds, and t_he City receives a.4%
administrative fee for acting as the fiscal intermediary for this position. Because of the 4%
administrative fee; there will be a positive impact of approximately S6,120 to the General
Fund each fiscal yeaz. If homeland security grants no longer fund this position. then it will
be eliminated.

ORDINANCE OF THE CITY OF CHULA VISTA AMENDING
CHULA VISTA MUNICIPAL CODE SECTION 2.05.010
RELATING TO THE ESTABLISHMENT OF UNCLASSIFIED
POSITION'S TO ADD FISCAL AGENT PROGRAM
ASSISTANT
WHEREAS, the Human Resources Department has created new classifications to better
reflect the needs of the Cit}~'s workforce; and
WHEREAS, Chula Vista City Charter Section 500(a) requires that all new unclassified
management level positions be adopted by ordinance and afour-fifths vote of the Council.
NOW THEREFORE the City Council of the City of Chula Vista does ordain as follows:
Section I. That Section 2.05.010 of the Chula Vista Municipal Code is hereby
amended to read as follows:
2.0.10 Unclassified positions established.
In addition to those unclassified positions specifically delineated in Section 500 of the Charter of
the City, there are established the unclassified positions entitled: Administrative Services
Manager; Advanced Planning Manager; Animal Care Facility Administrator, Animal Care
Facility Manager, Assistant. Chief of Police, Assistant Director of Development Services,

Section II. Severabilih~
If any portion of this Ordinance; or its application to any person or circumstance; is for
any reason held to be invalid; unenforceable or unconstitutional, by a court of competent
jurisdiction. that portion shall be deemed severable, and such invalidity; unenforceabilirv or
unconstitutionality shall not affect the validity or enforceabilih of the remainins portions of the
Ordinance, or its application to any other person or circumstance. The Cih~ Council of the City of
Chula Vista hereby declares that it would have adopted each section; sentence; clause or phrase
of this Ordinance; irrespective of the fact that any one or more other sections. sentences, clauses
or phrases of the Ordinance be declared im~alitt, unenforceable or unconstirutional.
Section III. Construction
The City Council of the City of Chula Vista intends this Ordinance to supplement, not to
duplicate or contradict; applicable state and federal laws and this Ordinance shall be construed in
lieht of that intent.
Section IV. Effective Date
This Ordinance shall take effect and be in force on the thirtieth day afrer its final passage.
Section V. Publication
The Citi~ Clerk shall certifi~ to the passage and adoption of this Ordinance and shall cause
the same to be published or posted according to la~v.
