DATED City Clerk Civil Defense and Disaster Agreement ";-..,' Q1ftAA-tA () ~ CI\~L DEFENSE AND DISASTER AGR.EEreHT w~~AS, the County of S~~ Diego, hereinafter referred to as the County, and the incorporated cities within the County signatory hereto, hereinafter referred to as the City or Cities as required by the context, are desirous of establishing a unified civil defense organization hereby designated as the UNIFIED SAN DIEGO COUNTY CIVIL DEFENSE AND DISASTER ORGANIZATION for the purpose of preparing mutual plans for the preservation and safety of life and property and making" provision for the execution of those plans in the event of enemy attack upon the United States ~~d to provide for mutual assistance in the event of a natural disaster, they, in consideration of the mutual covena~ts herein contained, de hereby mutually agree as follows: A. The County will perform the following services: 1. Aid, assist and advise each city in the preparation and development of a disaster plan for that city. 2. Prepare and develop a County-wide civil defense ~lan which shall provide for the needs of the contrac~ing cities and of the unincorporated areas of the CO'L~ty and which in addition will take into account a,d be coordinated with the needs of the cities in the event of a major natural disaster. Aid, assist and advise the cities with the traln1ng of public employees for the city disaster organizations. 4. Provide a County-wide civil defense program in each of 3. the following areas: ai Coroner services. bt Health. c~f~ Welfare. Traffic control. Medical. Provide technical assistance in obtaining any federal or state fUnds which may become available to the cities for civil defense purposes and in the acquisition by the cities of surplus property for civil defense purposes. 7. In the event of a disaster confined to one city, the County will offer assistance within the limits of its civil defense organization and will coordinate assist- ance fUrnished by other cities in accordance with mutual aid agreements. 8. In the event of a disaster within the County affecting an area greater than any one city, the County shall offer assistance to the extent of its civil defense establishment and shall direct and coordinate the B. assistance fUrnished by other cities. The cities shall: 1. By becoming signatories hereto become members of the Unified San Diego County Civil Defense and Disaster Organization. 2. Become parties to suoh mutual aid agreements as shall be deemed necessary by the San Diego County Civil Defense and Disaster Council, established herein. 3. Accept primary responsibility for the development within that oity of a disaster plan which shall be compatible with and oomplementary to the County-wide civil defense plan and organization to be developed pursuant to Paragraph A (2) above. Delegate to the San Diego County Civil Defense and 4. Disaster Counoil established herein whatever authority it is lawful for the cities to delegate when such delegation shall be deemed necessary by said Council. This delegation of authority shall be restricted to whatever expenditure of city fUnds and use of city personnel, equipment and supplies as are made available by the cities for civil defense purposes. -2- Ge In consideration of these mutual promises, it is hereby mutually agreed: 1. That the Go~~ty will pay fifty percent (50%) of the cost of establishing and maintaining the Unified San Diego County Civil Defense and Disaster Organization. 2. That the cities signatory hereto will pay fifty per- cent (50%) of the cost of' establishing and maintain- -ing the Unified San Diego County Civil Defense and Disaster Organization, said fifty percent (50%) to be apportioned among the cities in accordance with the folloWing formulae: One-half of the 50%, or 25% of the total budget, to be apportioned by people units or population: (a) Total population of all contractin~ cities di'lided into one-fourth o!: -;he total budget equals a factor in cents. (b) Population of each contracting city times the factor in cents equals the share for each city. The remaining 25% of the total bUdget to be appor- tioned by value units--assessed valuation of _each city. (a) Total assessed value of real and personal property L~ all contracting cities divided into one-fourth of the total budget equals a factor in mills. (b) Assessed value of each contracting city times the factor in mills equals the -share for each city. 3; (a) For purposes of this agreement the total assessed valuation of real and personal property in all con- tracting cities shall tie the most recent, such total maintained by the office of the Tax Assessor of' the County of San Diego (b) The figures used for population in each city shall be determined by a method which is mutually acceptatle to all signatories hereto. -3- . .. :~. D. The San Diego County Civil Defense and Disaster Council is hereby created and designated as the advisory body of the Unified 'San Diego County Civil Defense and Dis- aster Organization. It shall consist of the following: 1. The Chairman of the Board of Supervisors who shall be Chairman. 2. The Coordinator of Civil Defense and Disaster who shall be 7ice-Ghairman and who shall be selected by the Board of Supervisors from the following listl Chief Administrative Officer of the County or the City Manager and/or City Administrator of any in- corporated city in the County which has become a party to this agreement. Two additional persons shall be .selected from this list to act as alternates in the absence or inability of the Coordinator to serve, as first and second alternates. 3. A representative from the City Council of each in- corporated city within the County which has become a party to this agreement, or an alternate to be designated for each such municipal corporation. E. It shall be the duty of the San Diego County Civil Defense and Disaster Council and it is hereby empowered to review and recommend for adoption by the Board of Supervisors and all contracting cities, civil defense and disaster nn.ltual aid plans and agreements, and such ordinances, resolutions, rules and regulations as are necessary to implement suCh plans and agreements. The Civil Defense and Disaster Council shall meet upon call of the Chairman or in his absence from the County, or inability to call such a meeting, upon the call of the Coordinator of Civil Defense and Disaster. The Civil Defense and Disaster Council shall be empowered to recommend a budget and the apportionment thereof to the Board of Supervisors and all contracting cities. -4- F. There is hereby created the position of Coordinator of Civil Defense and Disaster. The Coordinator is hereby empowered 1. To request the Board of Supervisors to proclaim the existence or threatened existence of a disaster and 2. the determination thereof if the Board of Supe~visors is in session or to issue such proclamation if the Board of Supervisors is not in session subject to ratification by the Board of Supervisors at the earliest practical time. To request the Governor of the State of California through the Board of Supervisors to proclaim the existence of a state of extreme emergency when in the opinion of the Coordinator the resources of the area or region are inadequate to cope with a disaster or an emergency. 3. To coordinate the efforts of the parties to this agreement for the accomplishment of its purposes. 4. .-~ To represent either personally or by designated alternate the San Diego County Civil Defense and Disaster Council in all dealings with publiC or private agencies working in the field of civil defense and disaster. G. This agreement shall become effective upon the adoption ~. of appropriate enabling ordinances by the County and the Cities. H. This agreement may be terminated as to any of the parties by written notice given by such party. to all the other parties which notice shall be given at least 120 days prior to the commencement of the fiscal year in which it is to take effect. WIT N E SSE T H The parties hereto agree as follows: 1. Station is made State will furnish to the Custodian at State 1 s sole cost First Aid Units in accordance with attached Schedule IlAlr which, by this reference, a part thereof. 2. Custodian agr~es ~o provide, at its sole cost, storage facilities for said Units, secure from vermin 'and pilferage. Said storage to be equivalent to or better than that storage provided for siinilar equipme'nt belongin'g to the Custodian. Cwnership of said Units is and shall remain in the State. It is agreed that the original location for said Units is as shown on the attached inventory list. Delivery of First Aid Station Units to said location shall be arranged qy the State and, except where delivery is accomplished through municipal or county government, State shall pay cost of delivery. ArJY change of storage location shall be made only after due notice to and prior approval by the State and at the expense of the Custodian. h. The Custodian agrees to designate in writing the person(s) who ~~ll be authorized to sign for and accept physical custoqy of said Units and responsi- bility for their safeguarding. 'The Custodian shall not open cases, cartons or boxes for any i:nspection other than that designated by and sunervised by the State. .s. First Aid State of Disaster. dated February 25, Station Units may be used under certain conditions (See Bulletin 12, Revision 1, California Disaster 1957.) during a Cifice, State owned operational first aid supplies and equipment ~rlll be used for medical purposes only. In case of use of this eouipment, a report in "lITiting will be made by the Custodian to the Director, California Disaster Office (cC!{Y~ to Region) stating the circumstances under which it was used and reporting any damage or loss of equipment resulting therefrern. 7. The State assumes no liability hereunder fer clai."s cr losses accruing or resulting to any person, firm or corporation furnishing or supplying ..ark, services or material, or services in connection ~nth the performance of-this agreement, or for any claims and losses accruing or resulting to any person(s), firm or corporation injured or damaged by performance by either party hereunder. Transportation costs arising cecause of termination of contract shall be borne by the State. 9. This agr~ernent may be terminated by either party upon thirty days I vJ!'itten notice to the other party. In addition, the State may terminate and -vnthdraw the said First Aid Station Unit (5) on ten days' notice for failure to comply with any covenant or conditions contained herein. 10. carry out hours.
