RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA V]STA LEVYING THE ASSESSMENTS AI~1D
COLLECTIBLES FOR CITY OPEN SPACE DISTRICTS 1
THROUGH 7. 9. 11. 14. 1 ~. 17. 18. 20. 23. 24. 26. 31 AND 33.
EASTLAKE MAINTENANCE DISTRICT NO. 1 (ELMD #1);

WHEREAS, prior to the adoption of this Resolution, the Cit}~ Council caused the
formation of various districts under and pursuant to state law; and
V~%HEREAS, pursuant to Article 4; Chapter 1, part 2 of Division 15 of the California
Streets and Highways Code; also kno~.m as "Landscapine and Liehting Act of 1972" and Chula
Vista Municipal Code Chapter 17.07; NBS Government Finance Group; dba NBS has prepared
and filed: on behalf of and under the direction of the City Engineer, the Open Space Maintenance
Districts Annual Engineer's Report for all existing Open Space Maintenance Districts in the
City: and
WHEREAS, on July 9, 2013, Council approved the Ensineers Report and set July 23,
2013 as the date for the public hearing; and y
~l%HEREAS, the proposed assessments for Open Space Districts 1 through 7, 9: 11. 14,
1 ~. 17. 18. 20. 23. 24. 26. 31 and 33. Eastlake Maintenance District No. 1, and Bav Boulevard
Maintenance District for Fiscal Year 2013/2014 are as follows:

(1) OSD 33 was formed several years ago in anticipation of development. The project has not progressed and consequently there is no
maintenance required. Should the project develop in the future the District may be assessed to cover future maintenance expenses.
(2) Zones A - D share in the cost of Otay Lakes Road medians and off-site parkways. Collectible and projected revenue for Otay Lakes
Road are reflected in collectible and projected revenue for Zones A - D.
(3) Portions of Eastlake I and Eastlake Greens are in this benefit area.
(4) Bay Boulevard rates are based on acres.
(5) Town Centre rates have been based on parcel square footage since FY 2001/02. However, a Downtown PBID replaced this District
in 2001, but the City determined that there was some potential long-term exposure for the City based on the remote potential that [he
current PBID might not receive sufficient support for future renewal processes.
(6) The Projected Revenues are preliminary fgures based upon the prior years EDU assignments and the Maximum Rates for Fiscal
Vear 2013/14.
WHEREAS, the City Council of the City of Chula Vista held a public hearing on the date
and time set for such hearing; and
WHEREAS, all interested persons were afforded the opportunity to hear and be heard:
and
WEiEREAS, the City Council considered all oral statements and written protests made or
filed by all interested persons.

NOW. THEREFORE. BE IT RESOL\JED br the Cit`~ Council of the Citv_ of Chula
Vista, as to Open Space Districts 1 through 7, 9, 11,14. 1~. 17. ]8. 20, 23, 24, 26; 31 and 33.
Eastlake Maintenance District No. 1, and Ba~~ Boule~~ard Maintenance District for Fiscal Year
2013/2014, that it-.
1. Finds that ~~•ritten protests against the proposed assessments ha~~e not been made b.°
o«ners representing more than one-half of the area of land to be assessed; and
2. Confirms the diagrams and assessments contained in the Open Space Maintenance
Districts Annual Engineer's Report for Fiscal Yeaz 2013/2014; in the form presented to
the City Council. a cope of ~~hich is on file in the Office of the Cite Clerk (the
"Engineer's Report'); and
3. Orders that the open space and maintenance facilities be maintained.
BE IT FURTHER RESOLVED bv_ the Cite Council of the Cite of Chula Vista that the
adoption of this Resolution constitutes the le~~~ of assessments and collectibles as proposed in the
Engineer's Report for the 2013/2014 Fiscal Yeaz for Open Space Districts I through 7. 9; 11. 14.
Id. 17. 18, 20. 23, 24. 26. 31 and 33; Eastlake Maintenance District No. 1 (FEND irl), and Bav
Boule~~ard Maintenance District.
