HomeMy WebLinkAboutReso 1963-3127San Diego Gas & Electric : RESOLUTION No. 3127 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING GRANT OF EASEMENT FOR STORM DRAIN THE CITY COUNCIL OF THE CITY OF CHULA VISTA, DOES HEREBY RESOLVE AS FOLLOWS: , That certain dedication of an easement and right of way for constructiont maintenance and use as a storm drain, executed by the San Diego Gas and Electric Company, to the City of Chula Vista, dated the 14th day of May, 1963, a copy of which is attached hereto and hereby made a part hereof, the same as though fully set forth herein, be and the same is hereby accepted by the said City of Chula Vista. ..' , ADOPTED, AND APPROVED by the CITY COUNCIL of the CITY OF CHULA VISTA, CALIFORNIA, this 28th day of May 19~ by the following vote, to-wit: AYES: COUNCILMEN Smith, Menzel, McMains, McAllister. Full-filer City Administrator Gentlemen: In accordance with your request to construct a storm drain across this Company's 150-foot fee-owned transmission line right of way and the northerly portion of our South Bay Generating Plant property as shown on this Company's I"isc. Survey No. 1252, please be. advised that the easements will be executed by San Diego Gas & Electric Company subject, however, to the following terms and conditions: 1. That the channel construction will be accomplished in accordance with your plans entitled "14ajor Interceptor Drainage Facilit~' signed by Mr. Lane Cole, City Engineer, and dated April 10, 1963. 2. Our line will protrude above the storm drain flo"[ li.'1e an estimated three inches maximum at a point fifteen feet north of center line. "Ie estimate zero protrusion between five feet and fifteen feet south of center line. 3. City of Chula Vista, or their representatives, to expose our pipeline for a distance of twenty feet each side of center line, either prior to or during construction of the drain. At no time while our line is exposed or "1ightl~' covered will heavy equi~~ent be permitted to cross ,fithout first providing adequate protection acceptable to our inspector. 5. Subsequent to exposure, San Diego Gas & Electric Company forces ;[ill apply additional protective wrapping, attach reinforcing steel to the line and backfill to a point which will leav~ the pipe approximately one-half exposed. , --- / . City of Chula Vista, or their representatives, to place concrete in a maIL~er which will provide complete envelopment of the upper half of our line. 7. Work by City of Chula Vista, or their representatives, within the area of conflict with our ten-inch fuel oil line to be subject to approval by our inspector. 8. City of Chula Vista will relocate, at its mill expense, Company's existing chain link fence now located on our northerly property line to a position parallel to and contiguous with the south line of the proposed easement. San Diego Gas & Electric Company ,-Till stake the position of the new fence prior to relocation. 9. City of Chula Vista, its successors, assigns and agents shall save Company harmless from any and all damages occasioned by or arising from the City's construction, use and occupancy of the storm drain during and after the construction thereof. 10. City of Chula Vista .Till reimburse this Company for the total cost of Company's participation in the interceptor drainage project, including inspection costs; it is estimated that Company's costs will be approximately $950.00. It is respectfully requested that you obtain the approval of the Honorable City Council to the above terms and conditions so that we may transmit to you the executed right of way.
