HomeMy WebLinkAboutReso 2013-127 RESOLUTION NO. 2013-127 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE FISCAL YEAR 2012/2013 C1P BUDGET AND ESTABLISHING A NEW CAPITAL IMPROVEMENT PROJECT "EMERGENCY STORM DRAIN REPAIRS AT T STREET Ai\!D FOURTH AVENUE (DRI94)"; ACCEPTING THE FINAL REPORT OF EXPENDITURES FOR THE "EMERGENCY STORM DRAIN REPAIRS AT T STREET At"iD FOURTH A VHHJE (DRI94)"; REDUCING THE DRI93 CIP BUDGET BY $165,000 AND APPROPRIATING THE EQUIVALENT AMOUNT TO DR194; MAKING A FINDING THAT AN EMERGENCY EXISTED; AND, RATIFYING THE CONTRACT WITH ARRIETA CONSTRUCTION, 1Ne. FOR SAID EMERGENCY REPAIR WHEREAS, severely deteriorated sections of corrugated metal pipe (CMP) and corrugated metal pipe arch (CMPA) were discovered within the storm drain system on "E" Street at its intersection with Fourth Avenue: and WHEREAS, portions of this storm drain system had failed or were in imminent danger of failure, based upon closed circuit television (CCTV) inspection performed by City Public Works crews; and WHEREAS, failure of these portions of the storm drain system would lead to the collapse of surface improvements within the intersection, as well as cause damage to adjacent buildings; and WHEREAS, in light of previous failures within the system and the knowledge that additional failure was imminent, staff determined that immediate action was required to avoid damage to public and private infrastructure; and WHEREAS, this storm drain system was constructed in 1975 and has now reached or exceeded its practical service life: and WHEREAS, Public Works Operations had previously repaired one pipe segment (Feature ID 10724) on the north side of the road under the Bus Stop area; and WHEREAS, because the storm drain system at this intersection is relatively shallow, additional CMP failure was highly likely due to the inherent weakness of the deteriorated pipe and heavy traffic loading; and WHEREAS, Public Works Operations took temporary measures where necessary to provide protection and safety in the interim until permanent storm drain system repairs could be implemented: and Resolution No. 2013-127 Page No.2 WHEREAS, because of the advanced deterioration of this portion of the storm drain system, staff recommended that rehabilitation be performed immediately, on an emergency basis, due to imminent threat to public safety and public and private property; and WHEREAS, Public Works-Engineering staff estimated cost of this emergency repmr work to be $275,000, including construction and City staff costs; and WHEREAS, in accordance with City Charter Section 1009, and based upon the urgent necessity for the preservation of life, health and property, City staff solicited three informal bids and contracted the services of the lowest responsive bidder, Arrieta Construction, Inc., to repair the storm drain facilities; and WHEREAS, there is no impact to the General Fund as there are sufficient TransNet funds in the existing DR193, "Storm Drain Pipe Rehabilitation Project for Fiscal Year 2013," CIP budget to fund the emergency work under DR914; and WHEREAS, the DRI93 project was established in the Fiscal Year 2012/2013 CIP budget for emergency replacement of failed storm drains, primarily corrugated metal pipes, throughout the City; and WHEREAS, the repair was completed on February 27, 2013. An Informational Item was submitted on November 30, 2012, with the plan to report back to City Council after the full cost of the project was identified. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby amend the Fiscal Year 2012/2013 CIP budget and establish new crp Project "Emergency Storm Drain Repairs at 'E' Street and Fourth Avenue (DRI94)"; accept the final report of expenditures for the "Emergency Stom1 Drain Repairs at 'E' Street and Fourth Avenue (DRI94)"; reduce the DR193, "Storm Drain Pipe Rehabilitation Project for Fiscal Year 2013," crp budget by $165,000 and appropriate an equivalent amount to DR194; make a finding that an emergency existed, and ratify the contract with Arrieta Construction, rnc for said emergency repair work. Presented by Approved as to form by Richard A.
