RESOLUTION OF THE CITY PLANNING COMMISSION
APPROVING A PLANNED UNIT DEVELOPMENT
WHEREAS, a duly verified application for a Planned Unit Development was
filed with the Planning Department on November 3, 1970, by L. 0. Neely, and
WHEREAS, said application requested approval for the development of
1,62 acres located at the southeast corner of Hilltop Drive and Telegraph Canyon
Road, for which rezoning to R-1-5 has been requested; said development to consist
of 13 attached single family dwelling units, and
WHEREAS, the Planning Commission set the time and place for a hearing on
said application and notice of said hearing was given by the mailing of a notice
to property Owners within 300 feet of the exterior boundaries of the property at
least ten days prior to the hearing; and -
WHEREAS, the hearing was held at the time and place, namely 7 p. m.,
Monday, November 23, 1970, Council Chamber, Civic Center, 276 Fourth Avenue, before
the Planning Commission and said hearing was thereafter closed, and
WHEREAS, the Commission determined that the proposed development represents
a density compatible with the surrounding single family area, and
WHEREAS, this development represents a better use of land by providing
common open space and a desirable environment,
NOW THEREFORE SE IT RESOLVED THAT. THE CITY PLANNING COMMISSION approves
the concept of the Planned Unit Development to consist of 13 attached single family
dwelling units on 1.62 acres, subject to the following conditions:
1. The Planned Unit Development is subject to approval of a subdivision map.
2. The permittee shall make provisions as outlined below, to assure the continued
.maintenance and operation of all open space and improvements specified below
and obtain the City Planning Commission's approval of such provision:
The permittee and all. persons, firms or corporations owning the property
subject to this special use permit at the time of the recording of the final
map and their heirs, administrators, executors; successors and assigns shall
establish a Homeowners Association which shall have the duty to operate,
maintain and repair the open space recreational facilities and improvements
specified above primarily for the benefit of the residents of subject
development and.-shall continue to operate, maintain and repair such open
space, facilities and improvements until such time as the operation and
maintenance of said recreational facilities and improvements is assumed by
some public ager:cy, district corporation or legal entity approved by the City
Planning Commission.

In lieu of said Homeowners Association or in combination therewith, the
permittee may establish an Open Space Facilities and Improvement Maintenance
District pursuant to the ordinances of the City of Chula Vista, which district
shall have the power to assess the homeowners within the Planned Unit Develop-
. ment and levy such assessment annually to be collected with the tax bill by
the County Assessor for such amounts as may be necessary to perform said
service by contract with a private maintenance service corporation.
3. The architecture of .the structures-shall incorporate the following features: ,
a. The roofs shall utilize a combination of the and shake as shown on
the plans submitted.
b. All building elevations shall be architecturally coordinated using
rock, wood and stucco materials as indicated on the elevations submitted
by the applicant.
4. All setbacks, open space, parkway, and other landscaped ares shall be
landscaped in accordance with the Landscape Manual, and irrigated with a
sprinkler system. Special attention shall be given to the following:
a. Screening "Building A" from Telegraph Canyon Road.
b. Screening the recreation area from Hilltop Drive.
c. The area between "Building B" and the drainage channel.
d. Speciman plants shall be utilized to create an attractive entry into
the project.
5. Fencing of the project shall be as follows with details of the materials
to be used to be approved as part of site plan and arcfiitectural approval:
a. A 42" fence or wail along the Hilltop Drive property line from the
south property line to the drainage culvert.
b. A 6' fence or wall along the eastern property line (42" height within
the front setback area). If a fence is used it shall be interspersed
with masonry pilasters a minimum of 15' apart. Said fence shall. extend
to the edge of the drainage channel, then continue west, connecting
.with. the carport building.
6. Tiie drainage channel sha71 be improved as required by the City Engineer.
7. All exterior lighting visible from adjacent residences shall be subject to
staff approval.
8. The deed restrictions shall prohibit any conversion of a garage or carport.
9. This Planned Unit.Development shall be nul and void if not utilized within
one year after final adoption:

23rd day of November, 1970, by the following vote:
