ZAV-70-1 RESOLUTION OF THE ZONING ADMINISTRATOR GRANTING A ZONE VARIANCE WHEREAS, Leo W. and Josephine Kirkman, owner of property at 760 Myra Avenue, more fully described in application for zone variance which has been filed on said property for reduction of rear yard from 20 feet to 17 feet to accommodate construction of an addition to the dwelling, and WHEREAS, the Zoning Administrator has duly scheduled the same for hearing and the same came on regularly for hearing and the hearing was closed, and evidence having been presented to the Zoning Administrator concerning the granting or denying of said variance. NOW THEREFORE, the Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the owner exists. An accessory structure could cover 30% of the rear yard, this addition covers only 5%. b. That this variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same zone and in the vicinity of the subject property. A substantial addition could not be made while observing the required setbacks. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purpose of this ordinance or the public interest. Because of grade and linear separation there will be no detrimental effect. d. That the granting of a variance will not be contrary to the objectives of the General Plan. The General Plan will not be affected. NOW THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF CHULA VISTA, CALIFORNIA: That a variance is granted to Leo W. and Josephine Kirkman for reduction of rear yard from 20 feet to 17 feet at 760 Myra Avenue, for an addition to the existing dwelling. Said variance is granted subject to the following: a. A minimum of 10 feet of level ground shall be retained adjacent to the rear of the dwelling. Construction of a retaining wall may be required. b, Rain gutters shall be installed along the rear roof to catch run off from the roof and a Swale provided along the yard to channel the water to the street at the front of the property. This variance shall become ineffective and void if the same is not utilized within one year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance.
