RESOLUTION OF THE ZONING ADMINISTRATOR
GRANTING A-ZONE VARIANCE
WHEREAS, Nathan and Janet L. 6Jallace, owner of property at 745 Neptune
Court, more fully described in application for zone variance which has been
filed on said property for reduction of rear yard from 20 feet to 11 feet to
accommodate construction of an addition to the dwelling, and
WHEREAS, the Zoning Administrator has duly scheduled the same for
hearing and the same came on regularly for hearing and the hearing was closed,
and evidence having been presented to the Zoning Administrator concerning the
granting or denying of said variance.
NOW THEREFORE, the Zoning Administrator of the City of Chula Vista
does hereby find as follows:
a. That a hardship peculiar to the property and not created by any act of
the owner exists.
The irregular shape of the lot precludes an addition to the rear of the
house without encroaching into the required rear yard.
b. That this variance is necessary for the preservation and enjoyment of
substantial property rights possessed by other properties in the same zone and
in the vicinity of the subject property.
Other variances have been granted for similar encroachments.
c. That the authorizing of this variance will not be of substantial detriment
to adjacent property and will not materially impair the purpose of this ordinance
or the public interest.
There is ample area remaining and separation between residences, and adequate
open space is available on other portions of the rear and side yard.
d. That the granting of a variance will not be contrary to the objectives of
the General Plan.
The General Plan is not affected.
NOW THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF
CHULA VISTA, CALIFORNIA:
That a variance is granted to Nathan and Janet L. Wallace for reduction of rear
yard from 20 feet to 11 feet at 745 Neptune Court, for an addition to the
existing dwelling.
This variance shall become ineffective and void if the same is not
utilized within one year from the date of this resolution in accordance
with Section 33.1310 of the Zoning Ordinance.
PASSED and APPROVED by the ZOfdING ADMINISTRATOR OF CHULA VISTA, CALIFORNIA,
this 4th day of May, 1970.
