HomeMy WebLinkAboutZAV 1070-04 VARIANCE RESOLUTION #PCV-70-17 RESOLUTION OF THE ZONING ADMINISTRATOR GRANTING A ZONE VARIANCE WHEREAS, Dr. and Mrs. C.C. Medley, owners of property at 4165 Camino del Cerro Grande, more fully described in application for zone variance which has been filed on said property for reduction of north side yard from 15 feet to 11 feet for the purpose of constructing a single-family residence, and WHEREAS, the Zoning Administrator has duly scheduled the same for a hearing and the same came on regularly for hearing and the hearing was closed, and evidence having been presented to the Zoning Administrator concerning the granting or denying of said variance. NOW, THEREFORE, the Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the owner exists. The land was originally subdivided under the previous zoning ordinance which required that the side yard be "10% of the width of the lot with a soft maximum". b. That this variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same zone and in the vicinity. All of the homes within this subdivision were constructed under the previous zoning ordinance. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of this ordinance or the public interest. The approval of the setback reduction will not be detrimental to the adjacent property. d. That the granting of a variance will not be contrary to the objectives of the General Plan. The General Plan is not affected. NOW, THEREFORE., BE IT RESOLVED BY THE XONING ADMINISTRATOR OF THE CITY OF CHULA VISTA, CALIFORNIA: That a variance is granted to Dr. and Mrs. C.C. Medley for reduction of the north side yard from 15 feet to 11 feet at 4165 Camino del Cerro Grande, for the purpose of constructing a single-family residence. This variance shall become ineffective and void if the same is not utilized within one year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance.
