HomeMy WebLinkAboutZAV 1970-06 VARIANCE RESOLUTION N0. ZAV-70-6 RESOLUTION OF THE CITY ZONING ADMINISTRATOR GRANTING A ZONE VARIANCE 4JHEREAS, Mr. and Mrs. James E. Church, the owner of the property at 762 Madison Avenue, more fully described in application for zone variance which has been filed on said property for reduction of a portion of rear yard from 20 feet to 17 feet for the addition of a 14' x 16' family room to one apartment of a duplex in an R-2 zone. 6JHEREAS, the City Zoning Administrator has duly scheduled the same for hearing and tire same came on regularly for hearing and the hearing was closed, and evidence having been presented to the Zoning Administrator concerning the granting or denying of said variance. PJOW THEREFORE, the City Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of-the owner exists. If this addition vuere an accessory structure it could cover over ten times the proposed coverage of he rear yard. b. That this variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same zone and in the vicinity of the subject property. Other variances have been granted for similar additions. c. That the .authorizing of this variance will not be of substantial detriment to adjacent property and ~°~ill not materially impair the purposes of this Ordinance or the public interest. The addition covers only less than 3% of the rear yard, and there is ample open space provided in other portions of the lot. d. That the granting of a variance will not be contrary to the objectives of the General Plan. The General Plan is not affected. NOW THEREFORE, BE IT RESOLVED BY THE CITY ZONING ADMINISTRATOR OF IHE CITY OF CHULA VISTA, CALIFORNIA: That a variance is granted to Mr. and Mrs. James E. Church for reduction of a portion of rear yard from 20 feet to 17 feet for the addition of a 14' x 16' family room to a duplex dwelling at 762 Madison Avenue in an R-2 zone. This variance shall become ineffective and void if the same is not utilized within one year from the date of this resolution in accordance with Section 33.1370 of the Zoning Ordinance.
