RESOLUTION OF THE CITY ZOfJING ADMINISTRATOR
GRANTIfJG A ZONE VARIANCE
WHEREAS, Elmer P. and Carolyn R. Carlson, the owner of the property at
465 Vista Del Rancho, more fully described in application for zone variance which
has been filed on said property for reduction of side yard from 10 feet to 5 feet
for construction of a six foot high fence/wall parallel to Via De Laurencio, com-
mencing at the eastern property line and proceeding to a point 45 feet short of
the west property line, thence to the southwest corner of the house. Property is
zoned R-1-10.
WHEREAS, the City Zoning Administrator fias duly scheduled the same for
hearing and the same came on regularly for hearing and the hearing vaas closed,
and evidence having been presented to the Zoning Administrator concerning the
granting or denying of said variance.
NOW THEREFORE, The City Zoning Administrator of the City of Chula Vista
does hereby find as follows:
a. That a hardship peculiar to the property and not created by any act of the
owner exists.
Due to the excessive parkway, it would be a hardship to require-a 10'
setback.
b. That this variance is necessary for the preservation and enjoyment of substantial
property rights possessed by other properties in the same zone and in the vicinity of
the subject property.
The setback, if measured from curb face, is in excess of the requirement.
c. That the authorizing of this variance will not be of substantial detriment to
adjacent property and will not materially impair the purposes of this Ordinance or
,'the public interest.
fJo sight distance problems would be created.
d. That the granting of a variance will not be contrary to the objectives of the
General Plan.
The General Plan is not affected.
NOW THEREFORE, BE IT RESOLVED BY THE CITY ZONING ADMINISTRATOR OF THE CITY OF CHULA
VISTA, CALIFORNIA:
That a variance is granted to Elmer P. and Carolyn Carlson for reduction of side yard
from 10 feet to 5 feet for construction of a six foot high fence/wall parallel to Via
De Laurencio, commencing at the eastern property line and proceeding to a point 45
feet short of the west property line, thence to the southwest corner of the house at
465 Vista Del Rancho, in an R-1-10 zone.
Said variance is granted subject to the following:
a. The fence or wall shall be interspersed Faith used brick pilasters, a maximum of
15 feet apart. Another alternate will be considered subject to staff approval.
b. Landscaping shall be provided between the fence and property line, plans to
be approved by the staff.
c. An irrigation system shall be provided for the area outside the fence.
This variance shall become ineffective and void if the same is not utilized within
one year from the date of `this resolution in accordance with Section 33.1310 of the
Zoning Ordinance.
PASSED and APPROVED by the ZONING ADP~INISTRATOR OF CHULA VISTA, CALIFORNIA, this 16th
day of November, 1970.
