HomeMy WebLinkAboutZAV 1971-01 VARIANCE RESOLUTION N0. ZAV-71-1 RESOLUTION OF THE CITY ZONING ADMINISTRATOR GRANTING A ZONE VARIANCE WHEREAS, Edward M. Clune, the owner of the property at 1389 Nacion Avenue, more fully described in application for zone variance which has been filed on said property for reduction of a portion of the rear yard from 20 feet to 12 feet for the construction of a 12' X 18' addition to the rear of the residence in the R-1 zone, and WHEREAS, the City Zoning Administrator has duly scheduled the same for hearing and the same came on regularly for hearing and the hearing was closed, and evidence having been presented to the Zoning Administrator concerning the granting or denying of said variance. NOW THEREFORE, the City Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the owner exists. Because of the lot configuration the only practical area for a room addition is into the rear yard setback. b. That this variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same zone and in the vicinity of the subject property. Most of the lots in this area have a greater depth and therefore could accommodate additions to the rear. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of the ordinance or the public interest. An accessory structure could encorach into the rear yard setback, therefore, this minimal encroachment will not be detrimental. d. That the granting of a variance will not be contrary to the objectives of the General Plan. The General Plan is not affected by this variance. NOW THEREFORE, BE IT RESOLVED BY THE CITY ZONING ADMINISTRATOR OF THE CITY OF CHULA VISTA, CALIFORNIA: That a variance is granted to Edward M. Clune for reduction of a portion of the rear yard from 20 feet to 12 feet for the construction of a 12° X 18' addition to the rear of the residence at .7389 Nacion Avenue in the R-1 zone. This variance shall become ineffective and void if the same is not utilized within one year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance.
