HomeMy WebLinkAboutZAV 1971-02 UARIANCE RESOLUTION N0. ZAU-71-2 RESOLUTION OF THE CITY ZONING ADMINISTRATOR GRANTING A ZONE VARIANCE WHEREAS, Arby G. Kjorness, the owner of property at 609 East Manor Drive, more fully described in application for zone variance which has been filed on said property for reduction of front yard from 15 feet to 12 feet and of exterior side yard from 15 feet to 12 feet fora 27' X 26°3" addition to the existing dwelling in an R-1 zone. WHEREAS, the City Zoning Administrator has duly scheduled the same for hearing and the same came on regularly for hearing and the hearing was closed, and evidence having been presented to the Zoning Administrator concerning the granting or denying of said variance. NOW, THEREFORE, the City Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the owner exists. Because of the excessive parkway area, the setback from the curb would be more than normally required. Also, because of the lot configuration, it is difficult to add to another portion of the lot. b. That this variance is necessary for the preservation and enjoyment of sub- stantial property rights possessed by other properties in the same zone and in the vicinity of the subject property. Most dwellings in the area are set less than 15 feet from property lines. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of this Ordinance ar the public interest. Because of the excessive parkway, the structure will in no way block the line of sight around the corner or in any other way be detrimental. d. That the granting of a variance will not be contrary to the objectives of the ' General Plan. The General Plan is not affected. NOW THEREFORE, BE IT RESOLVED BY THE CITY ZONING ADMINISTRATOR OF THE CITY OF CHULA VISTA, CRIIFORNIA: That a variance is granted to Arby G. Kjorness for reduction of front and exterior side yards from 15' to 12' fora 27° X 26'3" addition to the existing dwelling ' at 609 East Manor Drive in an R-1 zone. This variance shall become ineffective and void if the same is not utilized within one year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance.
