HomeMy WebLinkAboutZAV 1971-04 VARIANCE RESOLUTION N0. ZAV-71-4 RESOLUTION OF THE CITY ZONING ADMINISTRATOR GRAfVTING OF A ZONE VARIANCE WHEREAS, Mr. and Mrs. K. J. Gautereaux, the owners of the property at 799 First Avenue more fully described in application for zone variance which has been filed on said property for reduction of a portion of side yard from 5' to 0` which would result from the construction of a room addition which would join the kitchen of the dwelling and an existing 9' x 11' laundry and storagebulding located on the north property line. bJHEREAS, the City Zoning Administrator has duly scheduled the same for hearing and the same came on regularly.: for hearing and the hearing was closed, and evidence having been presented to the Zoning Administrator concerning the granting or denying of said variance, NOW THEREFORE, the City Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the owner exists. Due to the shape of the lot, it is the only area that can be used for an adequate addition due to setback requirements. b. That this variance is necessary for the preservation and enjoyment of substantial property rights, possessed by other properties in the same zone and in the vicinity of the subject property. Enldrgement of the home will not exceed the maximum coverage allowed and will bring the home into conformity with adjacent homes in floor area. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of the Ordinance or the public interest. The adjacent property could not be developed in the area proposed for attachement and there will be ample separation of buildings providing light and air as per the intent of the ordinance. d. That the granting of a variance will not be contrary to the objectives of the General Plan. It will not be contrary to the objectives of the General Plan. NOW THEREFORE, BE IT RESOLVED BY THE CITY ZONING ADMINISTRATOR OF THE CITY OF CHULA VISTA, CALIFORNIA-.that a variance is granted to Mr. and Mrs, K. J. Gautereaux for reduction of a portion of the side yard from 5' to 0' to permit construction of a room addition which would join the kitchen of the dwelling and an existing 9' x 11° laundry and storage building located on the north property line. This variance shall become ineffective and-void if the same is not utilized within 1 year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance. PASSED and APPROVED by the CITY ZONING ADMINISTRATOR of CHULA VISTA, CALIFORNIA this 15th day of March, 1971. Zoning Administrator ATTEST: ~ ~ Secretary
