ZAV-72-2 RESOLUTION OF THE CITY ZONING ADMINISTRATOR GRANTING A ZONE VARIANCE WHEREAS, Bank of America, owners of the property at 295 E Street more fully described in application for zone variance which has been filed on said property for reduction of a portion of front yard from 10 feet to 0 to construct a 22 foot addition to the existing bank building located on the front property line in the C-T zone. WHEREAS, the City Zoning Administrator has duly scheduled the same for hearing and the same came on regularly for hearing and the hearing was closed, and evidence having been presented to the Zoning Administrator concerning the granting or denying of said variance. NOW THEREFORE, the City Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the owner exists. The existing structure was constructed on the property line prior to the present setback requirement of 10 feet. The proposed addition does not constitute a significant increase in building frontage. b. That this variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same zone and in the vicinity of the subject property. The other three corners at this intersection have 0 setbacks established by the Building Line Map. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of the ordinance or the public interest. 75% of the street frontage will not be used for building frontage. The amount and location of landscaping should more than offset any detriment which may be created by the granting of this variance. d. That the granting of a variance will not be contrary to the objectives of the General Plan. The granting of the variance will not be contrary to the objective of the General Plan to create a livable environment. NOW THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF CHULA VISTA, CALIFORNIA, that a variance is granted to Bank of America for reduction of a portion of the front yard from 10 feet to 0 for the construction of a 22 foot addition to the existing bank building in accordance with approved plans which include a 32 foot high slump stone wall and 132 feet of landscaping to screen the parking area. This variance shall become ineffective and void if the same is not utilized within one year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance..
