RESOLUTION OF THE CITY ZONING ADMINISTRATOR
GRANTING A ZONE VARIANCE
WHEREAS, James S. Wolniewicz, owner of property at 801 Fairway Court, more
fully described in application for zone variance which has been filed on said
property for reduction of a portion of rear yard from 10 feet td 6 feet in order
to construct a two-car garage on property located at 801 Fairway Court in the
R-1 zone, and
WHEREAS, the City Zoning Administrator has duly scheduled the same for
hearing and the same came on regularly for hearing and the hearing was closed,
and evidence having been presented to the Zoning Administrator concerning the
granting or denying of said variance.
NOW, THEREFORE, the City Zoning Administrator of the City of Chula Vista
does hereby find as follows:
a. That a hardship peculiar to the property and not created by any act of the
owner exists.
The present location of the existing dwelling will not permit the allowable
lot coverage of 40% without eliminating a usable rear yard.
b. That this variance is necessary for the preservation and enjoyment of
substantial property rights possessed by other properties in the same zone and
in the vicinity of the subject property.
The reduction of the rear yard setback will enable the applicant to replace
his present garage with another two-car garage, thereby retaining the character
of the neighborhood.
c. That the authorizing of this variance will not be of substantial detriment
to adjacent property and will not materially impair the purposes of the ordinance
or the public interest.
The reduction will not create a condition unlike adjoining interior lots
and will retain a usable rear yard.
d. That the granting of a variance will not be contrary to the objectives of
the General Plan.
NOW THEREFORE, be it resolved by the coning Administrator of the City of
Chula Vista, California, that a variance is granted to James S. Wolneiwicz for
reduction of a portion of the rear yard from 10 feet to 6 feet to construct a
two-car garage on property at 801 Fairway Court, subject to the condition that
the proposed addition shall not exceed 30% of the allowed rear yard area, or
480 square feet of development.
This variance shall become ineffective and void if the same is not utilized
within one year from the date of this resolution in accordance with Section
33.1310 of the Zoning Ordinance.
