RESOLUTION OF THE CITY ZONING ADMINISTRATOR
GRANTING A ZONE VARIANCE
WHEREAS, the San Diego Association for the Retarded, Starlight Center -
South Bay Chapter, the owner of property at 1280 Nolan Avenue, more fully
described in application for zone variance which has been filed on said property
fora reduction of front yard from 25 feet to 11 feet and exterior side yard
from 15 feet to 5 feet for construction of a 6 foot high chainlink fence along
the entire street frontage on both Nolan Avenue and East Oneida Street, and
WHEREAS, the City Zoning Administrator has duly given notice of said
request and set a date for consideration of objections or protests, and no
objections or protests having been submitted,
NOW, THEREFORE, the Zoning Administrator of the City of Chula Vista does
hereby find as follows:
a. That a hardship peculiar to the property and not created by any act of the
owner exists.
A 6 ft. high fence is necessary for security and protection measures which
could not be accomplished if the required setbacks were observed.
b. That this variance is necessary for the preservation and enjoyment of sub-
stantial property rights possessed by other properties in the same zone and in
the vicinity of the subject property.
The location of the fence at the setback line would prohibit access from
the front to the rear of the building from the outside.
c. That the authorizing of this variance will not be of substantial detriment
to adjacent property and will not materially impair the purposes of the ordinance
or the public interest.
The required landscaping and differences in elevation will screen the
fencing and reduce any adverse effects that may be created.
d. That the granting of a variance will not be contrary to the objectives of
the General Plan.
The General Plan will not be affected.
NOW, THEREFORE, BE IT RESOLVED by the 'Zoning Administrator of the City of
Chula Vista, California that a variance is granted to the San Diego Association
for the Retarded, Starlight Center - South Bay Chapter fora reduction of front
yard from 25 feet to 11 feet and exterior side yard from 15 feet to 5 feet for
a 6 foot high chainlink fence.
Said variance is granted subject to the following:
1. In those areas facing Nolan Avenue where landscaping has been eliminated,
aluminum or wooden slats shall be installed in the existing fence and gate.
2. The proposed gate across the entrance to the northerly parking lot shall
remain open during the hours that the Starlight Center is in operation.
