HomeMy WebLinkAboutZAV 1973-01 VARIANCE RESOLUTION N0. ZAV-73-1 RESOLUTION OF THE CITY ZONING ADMINISTRATOR GRANTING A ZONE VARIANCE WHEREAS, Mr. and Mrs. Charles W. Buchanan, the owners of property at 1418 Ocala Court, more fully described in application for zone variance which has been filed on said property for a reduction of side yard from 5 feet to 4 feet 4 inches for construction of a room addition, and WHEREAS, the City Zoning Administrator has duly given notice of said request and set a date for consideration of objections or protests, and no objections or protests have been submitted, NOW, THEREFORE, the Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the - owner exists. Due to the situation of the dwelling on an irregular shaped lot, the extension of the existing house configuration will encroach into the side yard setback area. b. That this variance is necessary for the preservation and enjoyment of sub- stantial property rights possessed by other properties in the same zone and in the vicinity of the subject property. Enlargement of the home will not exceed the maximum coverage permitted and will bring the home into conformity with adjacent homes in floor area. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of the ordinance or the public interest. There will be ample separation of buildings providing light and air in accord- ance with the intent of the ordinance. d. That the granting of a variance will not be contrary to the objectives of the General Plan. The General Plan is not affected. NOW THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR of the City of Chula Vista, California that a variance is granted to Mr: and Mrs. Charles W. Buchanan for reduction of a portion of the side yard from 5' to 4'4" to permit construction of a room addition which would join the present residence and be located adjacent to the north property line. This variance shall become ineffective and void if same is not utilized within one year from the date of this resolution in accordance with Section 33.1310 of the Zoning Ordinance. ZAV-72-5 RESOLUTION OF THE CITY ZONING ADP1INISTRATOR GRANTING A ZONE VARIANCE WHEREAS, Mr, and Mrs. Sam Persky, the owners of property at 497 Jamul Court, more fully described in application for zone variance which has been filed on said property for a reduction of rear yard from 20 feet to 6 feet for construction of a room addition, and WHEREAS, the City Zoning Administrator has duly given notice of said request and set a date for consideration of objections or protests, and no objections or protests having been submitted, NOW, THEREFORE, the Zoning Administrator of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the. property and not created by any act of the owner exists. Since this is a corner lot, additional yard requirements have been established which result in two rear or two front yards and, consequently, there is a reduction of those areas for allowable room additions. b. That this variance is necessary for the preservation and enjoyment of sub- stantial property rights possessed by other properties in the same zone and in the vicinity of the subject property. It would be possible to build to within 5 feet of a side property line on an interior lot. Since the applicant's rear yard is also a side yard (by definition of a corner lot) he should be permitted to build to within 5 feet of the property line. c. That the authorizing of this variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of the ordin- ance or the public interest. As long as the proposed addition does not exceed either the maximum rear yard coverage or the total lot coverage there should be no detriment to ad- jacent property. d. That .the granting of a variance will not be contrary to the objectives of the General Plan. The General Plan will not be affected. NOW, THEREFORE, BE IT RESOLVED by the Zoning Administrator of the City of Chula Vista, California that a variance is granted to Mr; and Mrs. Sam Persky fora reduction of rear yard from 10 feet to 6 feet for a room addition.
