ZAV-81-9 RESOLUTLON OF THE CITY PLANNING COMMISSION GRANTING A ZOPJE VARIANCE WHEREAS, Sleepy Time P+!otels, lessee of the property at the southwest corner of "H" Street and Oaklawn, filed an application fora zone variance with the City Planning Department for approval to build a motel structure on a lot containing 18,750 sq. ft. (in place of the required 20,000 sq. ft.), and to increase the density from 37 units to 40 .units, and WHEREAS, the City Planning Commission has duly scheduled the application for public hearing and the same came on regularly for hearing and the hearing was closuc?; and evidence having been presented to the Planning Commission concerning granting or denying of said variance, and WHEREAS, the Commission found that the project will have no significant environmental impact and adopted the Negative Declaration on IS-81-28. NOW, THEREFORE, BE TT RESOLVED AS FOLLOIdS: a. That a hardship peculiar to the property and not created by any act of the owner exists. The ordinance requirement for 600 sq. ft. of land area for each unit in the motel i,s based, at least in part, on standard surface parking with areas set aside for such features as a pool, restaurant o.r other amenity. The applicant has expels^ienced a practical difficulty in designing a project which. does not incorporate those features and which still makes efficient use. of the site. b. That such variance is necessary for the preservation and enjoyment of substan- tial property rights possessed by other properties in tfe same zoning district and in the same vicinity, and that a variance would not constitute a special privilege of the recipient not enjoyed by his neighbors. Other motels located in the same zoning district are built to densities exceeding the one uni per 600 sq. ft. In addition, other units are con- stru~ted on lots containing less than 20,000 sq. ft. Therefore, requiring ibis development to adhere to those standards would deprive the applicant of a property right now enjoyed by otfiers. c. That the authorizing of such variance will not be of substantial detriment to adjacent property, and will not materially impair the purposes of the zoning ordin- ance or the public interest. The plan proposes a building height, setbacks, walls and landscaping which meet or exceed all ordinance requirements, insuring that the project will not be detrimental to adjacent property. d. Thdt the.autharizing of such variance will not adversely affect the. general plan of the. city or the adopted plan of any governmental agency.. The proposed sign control, arch%tectural treatment and substantial setback for the buiading complies with th.e standards for the Scenic Highway Element of the General Plan; therefore, the plan will not adversely affect the General Plan. NOW, THEREFORE, BE IT RESOLVED BY THE: CITY PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNT:A; That a variance is granted to Sleepy Time Motels to build a motel structure on a lot containing 18,750 sq. ft. and to increase. the density from 31 units to 40 units, subject to the following conditions; 1. The existing utility pole and guy wire located adjacent to Oaklawn Avenue shall be relocated southerly to clear the proposed south driveway. 2. Signing shall be restricted to th.e freestanding sign submitted as part of the building elevation to be located at the corner of Oaklawn and "H", however, miscellaneous pedestrian oriented or traffic direc- tional signs may be approved 6y the Director of Planning. 3. The architectural form and treatment shall 6e consistent with the elevations submitted; however, final selection of materials; colors, and details for items such as balconies, lighting, etc., shall be subject to the approval of the Director of Planning. 4. Landscaping and irrigation plans shall be subject to the approval of the City's Landscape Architect, including any adjustments to the site plan deemed appropriate to enhance the overall appearance. This variance shall become ineffective and void if the same is not utilized within one year from the date of this resolution in accordance with Zoning Section 19.14.250 of the Municipal Code. PASSED AND APPROVED BY THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA this 25th day of March, 1981 6y the following vote, to-wit: AYES: Commissioners R.
