RESOLUTION OF THE CITY PLANNING COMMISSION GRANTI^;G A ZONE VARIANCE 4JHEREAS, The Bedroom, lessee of the property at 639 Broadway in the C-T zone, filed an application for zone variance with the City Planning Department for a reduction- in the minimum street frontage requirement in order to retain an existing 144 square foot rooftop sign on the commercial building at 639 Broadway, and WHEREAS, the City Planning Commission duly scheduled the application for public hearing and the same came on regularly for hearing and the hearing eras closed, and evidence havinn been presented to the Planning Commission concerning granting or denying of said variance, and 41HEREAS,-the application is exempt from environmental review as a Class 11(a) exemption. NOW, THEREFORE, the Planning Commission of the City of Chula Vista does hereby find as follows: a. That a hardship peculiar to the property and not created by any act of the applicant exists. A hardship exists due to the location of the building between other businesses which would obstruct the visibility of a storefront sign from the street; a rooftop sign is important to nullify this hardship. b: That such variance is necessary for the preservation and enjoyment of substantial property rights possessed 6y other properties in the same zoning district and in the same vicinity, and that a variance does not constitute a special privilege of the recipient not enjoyed by his neighbors. Granting the variance preserves the right town identification sign as afforded to other businesses in the area. c. That the authorizing of such variance will not be of substantial detriment to adjacent property and will not materially impair the purposes of the zoning ordinance or the public interest. The rooftop sign does not obstruct the view of other business identification signs in the area. d. That the authorizing of such variance vrill not adversely affect the general plan of the City of Chula Vista or the adopted plan of any governmental agency. Granting the request for retention of a business sign does nat affect the general plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA: That a variance is granted to The Bedroom to retain an existing rooftop sign on property at 639 Broadway with 50 feet of street frontage, subject to the following conditions: 1. When other nonconforming rooftop signs on the east side of Broadway between "I" Street and Halsey are removed, this rooftop sign will be removed. 2. In the event of a change in the land use at 639 Broadway the sign will be removed. PASSED AND APPROVED BY THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA this 11th day of August, 1982, by the following vote, to-wit: AYES: Commissioners Green, Stevenson, O'Neill, G.
