ZAV-88-20 I RESOLUTION OF THE CITY OF CHULA VISTA PLANNING COMMISSION GRANTING A VARIANCE ~ WHEREAS, a duly verified application for a variance was filed with the Planning Department of the City of Chula Vista on June 3, 1988, by Dennis E. White, and 4JHEREAS, said application requested permission to (1) reduce the I sideyard setback on the southerly property line from 25 ft. to 15 ft., (2) reduce the sideyard setback on the northerly property line from 25 ft, to 23 ft., and (3) increase the height of fencing in the front yard setback from 3.5 ft. to 5.0 ft. ih order to construct a single family dwelling on Lot 158, Rancho Robinhood III subdivision, and WHEREAS, the Planning Commission set the time and place for a hearing on said conditional use permit application and notice- of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the city and its mailing to property owners within 300 feet of the exterior boundaries of the property at least ten days prior to the hearing, and WHEREAS, the hearing was held at the time and place as advertised, namely 7:00 p.m., July 27, 1988, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the project is exempt from environmental review. NOW, THEREFORE, BE IT RESOLVED THAT 7HE PLANNING COMMISSION finds as follows: 1. The lot in question contains approximately 16,700 sq. ft. and a depth of 100 ft. The setbacks prescribed in the R-E zone are in anticipation of lots having a minimum of 20,000 sq. ft. and a lot depth of approximately 200 ft. 2. Other properties in the general vicinity have setback requirements less restrictive than the subject lot. 3. The lot abuts an open space to the rear and is proposed to he graded 10 ft. lower than the immediate parcel to the east. The increased fence height is necessary to comply with pool safety standards. 4. The General Plan is not affected by the granting of this request. BE IT FURTHER RESOLVED THAT THE PLANNING COMMISSION hereby grants the variance, subject to the condition of site plan and architectural review by the Planning Director. This variance shall become void and ineffective if the same is not utilized within one year from the date of this resolution in accordance with Section 19.14.260 of the Municipal Code.
