RESOLUTION OF THE CITY OF GHULA VISTA ~
PLANNING COMMISSION GRANTING A VARIANCE
WHEREAS, a duly verified application for a variance was filed with
the Planning Department of the City of Chula Vista on July 12, 1988, by Dr.
Nick Gustaro, and
WHEREAS, said application requested permission to locate parking
within the exterior sideyard setback along Smith Avenue in conjunction with a
proposal to construct a two-story office building at the northeast corner of
"H" Street and Smith Avenue, and
WHEREAS, the Planning Commission set the time and place for a hearing
on said conditional use permit application and notice of said hearing,
together with its purpose, was given by its publication in a newspaper of
general circulation in the city and its mailing to property owners within 300
feet of the exterior boundaries of the property at least ten days prior to the
hearing, and
WHEREAS, the hearing was held at the time and place as advertised,
namely 7:00 p.m., August 10, 1988, in the Council Chambers, 276 Fourth Avenue,
before the Planning Commission and said hearing was thereafter closed, and
WHEREAS, the project is exempt from environmental review.
NOVd, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION finds as
follows:
1. Setbacks on both street frontages are not required at numerous
other locations throughout the City. To apply the requirement
in this case, would therefore single out this lot in a fashion
different from other lots.
2. It has been shown that other lots across Smith Avenue and
property on "H" Street do not have setbacks, and thus the
granting of the variance represents something that is enjoyed by
other corner lots in the same general vicinity and zone.
3. Granting of the variance will be of substantial benefit to the
community and to the people in the general vicinity.
4. The variance is not contrary to the aesthetic values embodied in
the Chula Vista General Plan.
BE IT FURTHER RESOLVED THAT THE PLANNING COMMISSION hereby grants the
variance.

PASSED AND APPROVED BY THE PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA,
this 10th day of August, 1988, by the following vote, to-wit:
