DRC-91-66 RESOLUTION OF THE CITY OF CHULA VISTA PLANNING I COMMISSION APPROVING AN APPEAL OF THE DESIGN REVIEW COMMITTEE'S DECISION TO CONDITIONALLY APPROVE CONSTRUCTION OF AN OUTDOOR DINING AREA AND INSTALLATION OF A 28'-5" BY 16'-5" by 13' HIGH PLAY STRUCTURE AT 1100 BROADWAY WHEREAS, a duly verified appeal form was filed with the Planning Department of the City of Chula Vista on January 3, 1992, by Carl Karcher Enterprises, Inc., and WHEREAS, said appeal requested that the imposed DRC conditions of project approval requiring: a. Reduction of the proposed play structure's mass, b. Increase of the landscape screen/buffer area along the proposed addition's perimeter, c. Enhancement of the proposed wrought iron fence, d. Landscaping amenities within the outdoor dining area be deleted. WHEREAS, the Planning Commission set the time and place for a hearing on said appeal and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City and its mailing to property owners within 300 feet of the exterior boundaries of the property at least ten days prior to the hearing, and WHEREAS, the hearing was held at the time and place as advertised, namely 7:00 p.m., February 12, 1992, in the Council Chambers, 276 Fourth Avenue,. before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Planning Commission heard testimony from the applicant concerning the merits of the project and Planning Department staff presentation in opposition of the proposed play structure's mass, .screening and design; and WHEREAS, the Planning Commission considered all of the design principles and standards set forth in the Chula Design Review Manual, and WHEREAS, in reviewing the principles and standards of the Design Manual, the Commission determined that the subject play structure design and outdoor dining area layout was in compliance with the adopted design standards, and WHEREAS, the project is exempt from environmental review as a Class 11(c) exemption. i NOW, THEREFORE, BE IT RESOLVED that the Planning Commission finds as follows: 1. The proposed play structure is architecturally compatible in terms of mass, bulk, height and scale with the existing restaurant facility. 2. The proposed landscaping will adequately address aesthetic and screening concerns relating to the size of the proposed play structure. BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the City Clerk.
