RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL THE ADOPTION OF AN AMENDMENT TO THE ZONING ORDINANCE
MODIFYING SECTION 33.1204, THE CONDITIONAL ZONING PROVISION
WHEREAS, to create a greater degree of flexibility when rezoning properties
from a more restrictive to a less restrictive category, the Commission finds it
desirable to modify the Conditional Zoning provision in the Zoning Ordinance, and
WHEREAS, the Planning Commission set the time and place for a hearing on
said matter, and notice of said hearing, together with its purpose, was given by
the publication in a newspaper of general circulation in the City at least 10 days
prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7 p. m., Monday,
July 7, 1969, Civic Center, 276 Guava Avenue, before the Planning Commission, and
said hearing was thereafter closed.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
From facts presented to the Commission, the Commission finds that public
necessity, convenience, general welfare and good zoning practice require the adoption
of an ordinance which would read as follows:
SECTION CONDITIONS - ZOfdING
Neither the Planning Commission nor the City Council may attach
any conditions to the zoning of any property except for supplemental
zones as provided in this Chapter, and the property owner shall be
authorized without restriction to use the property for the uses and
purposes enumerated in the zone subject only to the regulations of
the zone, provided, however, that the Cor~ission may recommend or the
Council may require on its own motion that all public improvements,
including streets and sidewalks and drainage facilities, as well as
necessary dedications deemed needed to serve the uses authorized under
the proposed zoning be installed as a precedent to the zoning in order
to prevent the imposition of a burden upon the community and the City
created by said uses. The requirement for installation of public
improvements may be deferred in accordance with the provisions as set
forth i n this code.
In addition to the requirement for the installation of public
improvements in necessary dedications the Planning Commission or the
City Council may require that a precise plan for the development of
the property, which may include but is not limited to the location of
the building or buildings, architectural features of the building,
general plot plan, parking areas and landscaping, be submitted and
approved by the Planning Commission before the zoning recommended for
the property shall become effective.
The requirement for such a precise plan shall be limited to those
circumstances where (1) the suitability of the full-range of permitted
uses within the zone is accepied but it is recognized that said uses
roigllt, for any particular one of said uses under certain development
plans, have a detrimental effect on the surrounding properties; (2) such
uses are indicated on the adopted general plan but the surrounding
development or community requirements do not clearly warrant nor neces-
sitate the present rezoning for the uses thus shown; or (3) development
in the absence of a precise plan could adversely affect prospective
development of surrounding properties.
PASSED and APPROVED by the CITY PLANNING COMMISSION of CHULA VISTA, CALIFORNIA, this
7th day of July, 1969, by the following vote, to-wit:
