HomeMy WebLinkAbout1969-583 RESOLUTION N0. 583 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE CHAtVGE OF ZONE AND PREZONING FOR THAT AREA ON L STREET BETWEEN FOURTH AND FIFTH AVENUES WHEREAS, a duly verified application for a change of zone was filed with the City Clerk on 7th day of April, 7969, Document Number 69-K, and WHEREAS, said application requested that the property located at L Street between Fourth and Fifth Avenues more particularly described in said Document, be reclassified from County R-2-A zone to R-3 zone, and WHER~9S, the Planning Commission set the time and place fora hearing on said application, and notice of said hearing, together with its purpose, was given by the publication :.n a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7 p.m., Monday, August 4, 1969, Council Chamber, Civic Center, 276 Guava Avenue, before the Planning Commission, and said hearing was thereafter closed. IVOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice require the prezoning of that property on the south side of L Street between Fourth and Fifth Avenues with the exception of four parcels fronting on Fifth Avenue from County R-2-A to R-3-G-P (one unit per 2,500 square feet) with the attachment of the "P'° (Precise Plan) modifying zone (plat attached). The 4 parcels on nth Avenue shall be prezoned R-2. This ordinance shall become effective only as approved plans for development are submitted. 2. The Findings of fact in support of said determination are as follows: a. The configuration of the .parcels and existing land use are such that the flexibility of R-3-G zoning is necessary to facilitate good development. _ b. With the attachment of the Precise Plah, a development will be assured that will bA compatible with the surrounding res- idential area.. c. Since no need exists at this time;-and since the property owners have objected, the property presently in t{ie City; will not be rezoned: . 3. The Planning Commission recommends to the City Council that said reclassification be granted. 4. That this resolution be transmitted, along evith the application to the City Council, and a copy of this resolution shall be transmitted to the ap- plicant. PASSED and APPROVED by the CITY PLANNING COMMISSION of CHULA llISTA, CALIFORNIA, this 4th day of August, 1969, by the following vote, to-wit: AYES: Members Adams, Stewart Putnam, Macevicz, Chandler, and H,~de NOES: None Member :??Rice T° J Chairman ATTEST: Secretar
