HomeMy WebLinkAbout1969-591 RESOLUTION N0. 591 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE ADOPTION OF AN ORDINANCE AMENDING ARTICLE 5 OF CHAPTER 33 OF THE CHULA VISTA CODE BY DELETING LICENSED NURSING HOMES AS AN ACCESSORY USE IN THE R-3 ZONE FROM SECTION 33.505, AND BY AMENDING SUBSECTION A(8) OF SECTION 33.517 "UNCLASSIFIED USES" 4dHEREAS, the City Planning Commission of Chula Vista has heretofore considered certain problems relative to the conduct of nursing homes for retarded children in the R-3 Residential Zone of the City, permitted as an accessory use, and WHEREAS, the Planning Commission at their meeting of September 3, 1969,. recommended to the City Council an amendment of the- Zoning Ordinance establishing such use as an Unclassified Use, and deleting such use as an accessory use in said R-3 Zone, and such was adopted by the `City Council on September 16, 1969, as an emergency ordinance, and WHEREAS, the City Planning Commission now deems it advisable, in the community interest as well as in the interest of individuals seeking to establish such a use, to recommend that the City Council adopt a permanent ordinance, pursuant to the provisions of the Charter of the City of Chula Vista, which ordinance places all nursing homes in the Unclassified Uses section, and deletes such use as an accessory use in the R-3 Zone. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds that the public necessity, convenience, general welfare and good zoning practice require the adoption of the following amendment to the Zoning Ordinance: Section 33.505, subsection C, is hereby amended to read as follows: C. Accessory Use. 1. .Rooming and boarding of not more than six (6) persons. 2. Customary incidental home occupations subject to provisions of Section 33.1314. 3: Other accessory uses and accessory buildings customarily appurtenant to a permitted use subject to requirements of subsection 1 of Section 33.901 A. 4. Temporary tract offices and tract signs subject to the provisions of subsections 28 and 31 of Section 33.901 A. Section 33.517, subsection A (8) is hereby amended to read as follows: 8. Hospitals, including but not limited to, emergency, general, convalescent, rest homes, nursing homes (for the aged, crippled, mentally retarded of all ages) psychiatric, etc. Further, that approval shall not be granted until the following findings can be made by the Planning Commission (homes for mentally retarded children): a. The size of the parcel to be used shall provide adequate light and air in proportion to the number of residents. b. The location of windows and open play areas shall be approved by the Planning Commission. c. Spacing between these facilities she-11 be such that the character of the neighborhood is not affected by the grouping of these homes. 2. The Planning Commission recommends to the City Council that said amendment be adopted. 3. That this resolution be transmitted to the City Council. PASSED and A`.~PROVED by the CITY PLANNING COMMISSION of CHULA VISTA, CALIFORNIA this 20th day of October, 1969, by the following vote, to-wit: AYES: Members Rice, Adams, Putna, Macevicz, Chandler, Hyde, Stewart NOES: None ABSENT: None ~ Chairman ATTEST: Sect
