EIR-72-1 RESOLUTION OF THE CITY PLAfJNING COMMISSION ADOPTING AN ENVIRONP1ENTAL IMPACT REPORT WHEREAS, a Draft Environmental Impact Report was filed by the American Housing Guild on the 14th day of December, 1972, Document No. EIR-72-1, and WHEREAS, tf>3e American Housing Guild requested consideration of the Draft Environmental Impact Report as the City of Chula Vista's Environ- mental Impact Report on a requested revision of the General Plan and change of zoning for approximately 4.57 acres on the north side of Orange Avenue and east of the proposed extension of Max Avenue, more particularly described in said document, and WHEREAS, said Draft Environmental Impact Report was posted and avail- able for public scrutiny ahd review for a period of twenty working days, and WHEREAS, the Planning Commission set the time and place for a hearing to consider said Environmental Impact Report, and notice of said hearing, together with its purpose, was given by .the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., January 22, 1973, in the Council Chamber, Civic Center, before the Planning Commission and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. From the facts presented to the Commission, the Commission finds that, in accordance with the Environmental Quality Act of 1970, said Draft Environmental Impact Report of American Housing Guild on a requested re- vision of the General Plan and change of zoning for approximately 4.57 acres on the north side of Orange Avenue and east of the proposed extension of Max Avenue is required to be adopted as the City of Chula Vista's Environmental Impact Report on said General Plan revision and rezoning, subject to the following conditions: a. That, prior to the issuance of any grading permit on subject site, evidence shall be provided to the Environmental Review Coordinator that no trace of the La Nacion fault systems trans- verses the project site. If such a trace does transverse the site, then the applicant's geologist shall provide the City with adequate development standards including set back and construction techniques which will mitigate any adverse impact from the fault _ _ _ -2- trace and the applicant shall submit to the Planning Commission a revised precise plan delineating these mitigating measures. b. The minutes from the public hearing be added to the appendix section of the report. PASSED and APPROVED by the CITY PLANNING COMMISSION of CHULA VISTA, CALIFORNIA this 22nd day of January, 1973, by the following vote, to-wit: AYES: Members Wilson, Chandler, Macevicz, Rice, Rudolph, Swanson and Whitten NOES: None ABSENT: None Chairman ATTEST: € j Acting Secretary
