STL390)" PROJECT TO JUST CONSTRUCTION, INC. IN THE AMOUNT OF $163,000, WAIVING CITY COUNCIL POLICY 574- 01, AND AUTHORIZING THE EXPENDITURE OF ALL AVAILABLE CONTINGENCY FUNDS IN N AMOUNT NOT TO EXCEED $25,000 SUBMITTED BY: DIRECTOR OF PUBLIC WORKS ASSISTANT DIRECT OF ENGINE RING REVIEWED BY: CITY MANAGER ASSISTANT CITY ANAGER 4/STH5 VOTE: YES ^ NO SUMMARY On June 19, 2013, the Director of Public Works received nine (9) sealed bids for the "Cross Gutter Rehabilitation at Various Locations FY12/3 (CIP No. STL390)" Project. The project will remove and replace cross gutters that are in disrepair on various City streets as listed in the Attachment 1. The proposed resolution, if approved, would accept bids, award a contract for this project to the low bidder, Just Construction, Inc. in the amount of $163,000, waive City Council Policy 574-01, and authorize the expenditure of all available contingency funds in an amount not to exceed $25,000. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the proposed capital improvement project qualifies fox a Class 1 (c) categorical exemption pursuant to Section 15301 [Existing Facilities] of the State CEQA Guidelines because the project consists of removal and replacement of existing street cross gutters and related improvements involving negligible or no expansion of an existing street use. Thus, no further environmental review is required. RECOMMENDATION Council adopt the resolution. 6-1 7/16/13, Item Page 2 of 4 BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION This project was included in the FY2012/2013 Capital Improvement program budget to rehabilitate existing cross gutter that in disrepair at various locations within the City. The STL390 project is funded by Prop 42 Traffic Congestion Relief fund. Project design staff prepared specifications and location plats and advertised the project on May 31, 2013. On June 19, 2013, the Director of Public Works received the following nine (9) bids: CONTRACTOR BID 1 Just Construction, Inc. -San Diego, CA $163,000.00 2 PCI Portillo Concrete, Inc. -Lemon Grove, CA $199,694.50 3 Crest Equipment, Inc. - El Cajon, CA $199,863.75 4 Blue Pacific Engineering and Construction -San Diego, CA $207,039.00 5 Jaycor Construction Technologies, Inc. -Santee, CA $207,119.30 6 New Century Construction, Inc. -Lakeside, CA $229,842.00 7 PAL General Engineering, Inc. -San Diego, CA $237,733.50 8 HTA Engineering & Construction, Inc. -San Diego, CA $257,462.09 9 Tri-Group Construction and Development, Inc. -San Diego, CA $260,081.00 The low bid submitted by Just Construction, Inc. is below the Engineer's estimate of $225,620 by $62,620 (approximately 28% below the Engineer's estimate). Just Construction, Inc. has satisfactorily performed construction projects of similar scope for the City in the past. Just Construction, Inc. is a licensed General Engineering Contractor (Class A), General Building Contractor (Class B), and Concrete Contractor (Class C) under California License No. 968910. Their license status is current and active per the Department of Consumer Affairs' Contractors State License Board. The proposed resolution would also authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Works under Policy No. 574-01 is $21,410. Approval of the proposed resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the contingency amount of $25,000, an increase of $3,590 over Policy No. 574- 01. Increasing the contingency funds will allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of 6-2 7/16/13, Item :o Page 3 of 4 construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazardous materials, unexpected underground conflicts, eta If the contingency funds are not used, then they will be returned to the project fund balance. Further, because the contractor's bid is lower than the Engineer's estimate, some of the supplemental locations listed in Attachment 1 will be completed using contingency funds. The proposed resolution, if approved, would accept bids, award a contract for this project to the low bidder, Just Construction, Inc. in the amount of $163,000, waive City Council Policy 574- 01, and authorize the expenditure of all available contingency funds in an amount not to exceed $25,000. Waae Statement The contractors who bid on this project are not required to pay prevailing wages to persons employed by them for the work performed under this project. However, a "Notice to Contractors" was sent to various trade publications in order to encourage disadvantaged business enterprises (DBEs) to bid on the project. Disclosure Statement Attachment 2 is a copy of the Contractor's Disclosure Statement. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not independently aware, nor has staff been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT A breakdown of the project costs is as follows: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount $163,000 B. Contingencies (15%~ $25,000 C. Construction Inspection Staff Time (12%) $25,000 D. Design Sup orUSurvey/Monument Preservation $10,000 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $ 223,000 Sufficient funds are available in the account balance of CIP Project No. STL390. There is no direct fiscal impact to the General Fund as this project is funded with Prop 42 Traffic Congestion Relief funds.
