EIR-79-5(a) RESOLUTION OF THE CITY OF CHULA VISTA PLANNING COMMISSION CERTIFYING AN ENVIRONMENTAL IMPACT REPORT WHEREAS, Sammis Properties, Inc., requested the consideration of the following discretionary actions by the City of Chula Vista: (1) a General Plan Amendment changing the designation of the property located north of the prolongation of "E" Street to the west of Interstate 5 from "Park and Public Open Space" to "Visitor Commercial"; (2) consideration of the development of said property and property immediately to the east by the Design Review Committee; (3) an ownership partici- ation agreement with the Redevelopment Agency of the City of Chula Vista; and I (4) an encroachment permit for the utilization of Bay Boulevard for park circula- tion and landscaping, and WHEREAS, Sammis Properties,-Inc., authorized the City of Chula Vista to prepare an environmental impact report and candidate CEQA findings and, if neces- sary, a statement of overriding considerations pursuant to California Public Resource Code Section 27000 et seq., California Administrative Code Section 15000 et seq. and the environmental impact report procedures of the City of Chula Vista, and WHEREAS, after evaluating proposals from WESTEC Services, Inc., and the I Environmental Review Committee of the City of Chula Vista amended the agreement with WESTEC Services, Inc., for the preparation of EIR-79-6(a) to provide for the i preparation of the above noted project, and WHEREAS, a Notice of Completion was sent to all responsible agencies, agencies having jurisdiction by law and the State Clearinghouse, and WHEREAS, after giving public notice in a newspaper of general circulation in the Chula Vista area, to all property owners within 300 feet of the project site and to all affected local, regional and State agencies, the .Environmental Review Coordinator held a public meeting to "scope" the issues to be evaluated in the environmental impact report, and WHEREAS, after the draft environmental impact report prepared by WESTEC Services, Inc., was given independent review and analysis by the City of Chula Vista staff, the document was issued by the Environmental Review Coordinator on November 24, 1982 as the City's draft environmental impact report for the project, and WHEREAS, legal notice of the availability of the draft environmental impact re port .was given through publication in a newspaper of general circulation in the City of Chula Vista on December 2, 1982, to all property owners within 300 feet of the project and a Notice of Completion was filed with the Secretary for Resources of the-State of California, and I WHEREAS, the Planning Commission of the City of Chula Vista held public ~ hearings on the .adequacy of the draft environmental impact report on January 12, f 1983 and February 9,1983 and the public hearing was closed on February 9, 1983, and WHEREAS, WESTEC Services, Inc., at the direction of City staff, prepared a final environmental impact report on the project including all comments on the draft environmental impact report and a response to each comment. NOW, THEREFORE, BE IT RESOLVED: From the facts presented to the Planning Corrnnission, the Commission certifies that the environmental impact report EIR-79-6(a) on the proposed Sammis Group Bay Boulevard project has been prepared in accordance with the California Env iron- mental Quality Act, State EIR Guidelines and the environmental review procedures of the City of Chula Vista and, furthermore, that the Planning Commission has i I reviewed the document and is .considering the information in the final environmental impact report as it reaches a decision on the project. PASSED AND APPROVED by the City Planning Commission of Chula Vista, California, i this 9th day of February, 1983., by the following vote, to-wit: AYES: Commissioners Shipe, Pressutti, Green, R.
