HomeMy WebLinkAboutEIR 79-08A - RESOLUTION N0. EIR-79-8-A RESOLUTIOPd OF THE CITY PLANfdING COMMISSION ADOPTING CEQA FINDINGS PURSUANT TO CALIFORNIA PUBLIC RESOURCES CODE SECTION 21081. AND ADOPTING FINDINGS OF OVERRIDING CONSIDERATION I WHEREAS, EIR-78-2 on the E1 Rancho del Rey Specific Plan was certified by the Planning Commission on February 22, 1978, and EIR-79-8 on the Rice - - Canyon Sectional Planning Area of the E7 Rancho del Rey Specific Plan was certified.by the Planning Commission on October 10, 1979, and WHEREAS, it is the policy of the State of California that no public agency shall approve a project for which an environmental impact report has been prepared in which significant impacts have been identified, unless it is infeasible to avoid those impacts due to specific technical, social, economic I or other considerations, and - WHEREAS, Advance Planning and Res ea rch.Associates, Inc. has prepared Candidate CEQA findings of fact pursuant to the California EnVironmentd l,i Qua.1i,ty Act of~1970~and those ~findingshave been reviewed by :the.Planning Department and j I recommended for adoption. NOW, THEREFORE, BE IT RESOLVED that in accordance with the attached I Candidate CEQA findings: - 1. The Planning Commission, having reviewed and considered the information contained in EIR-78-2 and EIR-79-8, finds that the implementation of specific mitigation measures recommended in the final EIR-79-8 will avoid significant - ~ - adverse environmental effects in the following areas: (Note - The number in parenthesis following each heading refers to the respective section number of the EIR.) a. Geology (3.3) b. Soils (3.4) c. Drainage (3.6) d. Archaeology (3.8)' e.. Paleontology (EIR-78-2, Sec. 5.11) li f. Transportation (3:70) g. Noise, short term (3.17) 2. The Planning Commission, having reviewed and considered the information contained in EIR-79-8, finds that the mitigation of the following impacts is within the responsibility and jurisdiction of other public agencies: a. Water Quality - Regional (3.7) b. Air Quality (3.12) c. Schools (3.16) d. Sewage - Regional (3.21) 3. The Planning Commission, having. reviewed the information in EIR-79-8, finds that there are specific economic, .social, and technical considerations which make infeasible the full mitigation of the following impacts as specified in the attached supplemental Candidate CEQA Findings: a. Landform (3.2) b. Biology (8.9) c. Aesthetics (3.13) I 4. The Planning Commission, having reviewed the information in EIR-79-8, . adopts the following findings of "overriding Considerations": a. The project will result in a more compact urban form and a resultant - reductionin energy consumption,_air pollutants, and a greater ease - inproviding urban services. ~i b. The project will provide for an increase in the housing stock in an I gj area close to the center of metropolitan San Diego. This increase - ~ _ will-include housing for low and moderate income families. This will ' - be of social benefit to the concnunity. c. The extension of a major element of the city'straffic circulation system (East "H" Street) will occur as a result of project implemen- tation. d. The project will promote alternate forms of energy saving transpor- tation,-such as car pooling and bus transportation with the installa- tion of a park-and-ride facility at the intersection of I-805 and ' East "H" Street.
