EIR-80-1 ' RESOLUTION OF THE CITY PLANNING COMMISSION CERTIFYING AN ENVIRONMENTAL IMPACT REPORT, NAKING FINDINGS PURSUANT TO CALIFORNIA PUBLIC RESOURCES CODE SECTION 27087 AND ADOPTING FINDINGS OF OVERRIDING CONSIDERATIONS WHEREAS, the City of Chula Vista is considering an addendum to the Chula Vista j i General Plan establishing phase growth policies, and WHEREAS, it was determined that said addendum could have a significant environ- mental impact and therefore it was necessary to prepare an environmental impact report, and WHEREAS, a preliminary draft environmental impact report was prepared by City staff, and WHEREAS, a draft of the environmental impact report was issued by the Environ- j mental Review Committee for agency and public review on August 23, 7979, and WHEREAS, legal notice of the availability of the draft environmental impact report was given by publication in a newspaper of general circulation on August 26, 1979 and a notice of completion was filed with the Secretary for Resources of the State of California, and WHEREAS, the draft environmentalimpact report was circulated by the State Clearinghouse of the State of California, and the City Planning Commission of the City of Chula Vista held public hearings on the adequacy of the draft environmental I impact report, and ~ I WHEREAS, said public hearings were closed and the City staff prepared modifica- tions to the draft environmental impact report and a response to all written comments and public testimony on the draft environmental impact report. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: From the facts presented to the Planning Commission, the Commission finds that - - EIR-80-1 has been prepared in 'compliance with the California Environmental Quality Act of 1970, as amended, and the Environmental Review Policy of the City of Chula Vista and hereby certifies that the Commission has reviewed and considered the information in the environmental impact report. i . BE IT FURTHER RESOLVED that thePlanning Commission having reviewed and considered the information in Environmental Impact Report 80-1, finds that the implementation of the Specific Development Plan of E1 Rancho del Rey, including ~I - the conservation section of the text, and implementation of the Open Space and Conservation Elements of the General Plan for the City of Chula Vista and the - ~ ~ standard Chula Vista developmental regulations will mitigate or avoid potentially significant environmental impacts identified in the final environmental impact - report in the following areas: 7. Geology 2. Soils ~ _ _ 3. Drainage I 4. Noise 5. Biology 6. Archaeology 7. Transportation and access i Note: The effectiveness of mitigation measures will be evaluated in subsequent environmental documents. ~ BE IT FURTHER RESOLVED that the Planning Commission finds that mitigation of cumulative impacts on water quality is the responsibility and is under the jurisdiction of other public agencies. Specifically, the City of San Diego is responsible for pro- ' viding adequate sewage treatment of affluent from thisproject and the San Diego Regional li _yJater Quality Control Board has the responsibility of assuring overall water quality in the San Diego Region. BE IT FURTHER RESOLVED that the Planning Commission finds that there are specific economic and technical factors which make infeasible the full mitigation of environ- mental impacts of land form alteration indirectly associatedwith the project. Specifically: a. Satisfactory mitigation of the topographic and visual effects is not possible except through the no project alternative. This alternative is infeasible due to the specific overriding economic and social conditions relative to anticipated growth demands placed on the San Diego Region over the 20-year period from 1975 to 1995. b. Housing development in this area will include housing affordable to middle income families and senior citizens. If development did not take place in accordance with the management policies, this much needed i - housing could take place in an outlying more environmentally sensitive area it and require longer vehicle trips and greater energy consumption and air quality impact. c. In order to provide safe andconvenient roadways through the property with grades and curves which are adequate for use by emergency vehicles, substantial land form alteration is necessary in some areas. ~ d, If the E1 Rancho del Rey Specific Plan is to be implemented with its conservation provisions, open space network and land use/density patterns, substantial land form alteration will be necessary. . _ BE IT FURTHER RESOLVED that the planning Commission finds that implementation of the Growth Management Poll1"ci'es would result in Indirect unmitigated significant - - en vironmenta1 consequences and therefore Identifies the following overriding con- i siderations as justifyingapprova1 of the project: - 1. The project will result in a more compact-urban form and a resultant .reduction in energy consumption, a-ir pollutants and a greater ease in providing urban services. 2. The project would provide for an increase in the housing Stock in areas close to the center of metropolitan San Diego. This increase will include housing for moderate income families and senior citizens. This will be of social benefit - to the community. I - 3.
