PESOLUTION OFTHE CITY.PLANNING COPIMI'SSION ADOPTING
_ CANDIDATE FTNDTNC,S Of FACT RELATING TO DEVELOPP9ENT OF
SOUTH COLLEGE SECTIONAL PLANNING AREA (CHARTER POINT)
WHEREAS, an environmental impact report, EIR-78-2 for the E1 Rancho del
- Rey Specific Plan was certified by the Planning Commission on February 22,
_ 1978 and EIR-80-4 for the South College Sectional Planning Area (Charter '
Point) was certified by the Planning Commission on March 79, 1980, and
WHEREAS, it is the pol-icy of the State of California that no public agency
shall approve or carry out a project for which an environmental impact report
has been prepared which identifies impacts which are significant unless it is
infeasible to avoid those impacts, and
WHEREAS, Multi Systems, Tnc. has prepared Candidate Findings of Fact in
accordance with the California Public Resources Code, and
WHEREAS, those findings have been reviewed by the Environmental Review
Section of the Planning Department and recommended for adoption.
NObI, THEREFORE, BE IT RESOLVED that in accordance with the attached Candidate
Findings of Fact:

7. The PlanningCommssion having reviewed and considered the information
in EIR-80-4 finds that changes or alterations. have been required in, or incorpor- ~

ated into, the project which mitigate or avoid the significant environmental
effects identified in the final Environmental Impact Report in the following
areas:
a. Land form
b. Biology
c. Transportation access
2. The Planning Commission, having reviewed and considered the information
in EIR-80-4, finds that the provision of educational services is the responsibility
of the appropriate school districts. with State funding sources. The City of Chula
Vista wi`71 continue to provide a mechanism for cooperation between the developer
and the school districts in providing adequate educational services. If the school

districts provide evidence of overcrowding, further actionsmay be necessary.
