EIR-85-1A j l RESOLUTION OF THE CITY PLANNING COMMISSION ADOPTING "CEQA FINDINGS" PURSUANT TO STATE CEQA GUIDELINES, SECTION 15091, AND A STATEMENT OF OVERRIDING CONSIDERATIONS PURSUANT TO STATE CEQA GUIDELINES, SECTION 15093, FOR THE PROPOSED BAYFRONT SPECIFIC PLAN AND AMENDMENTS TO THE SUBDIVISION ORDINANCE OF THE CITY OF CHULA VISTA i The City Planning Commission of the City of Chula Vista does hereby resolve as follows: UJHEREAS, the Planning Commission has certified EIR-85-1 concluding that there are environmental impacts which conceivably could occur with project implementation, and I WHEREAS, "Candidate CEQA Findings" and a "Statement of Overriding j Considerations" have been prepared for Planning Commission consideration, and WHEREAS, the California Resources Code (CEQA) and the Administrative Code (CEQA Guidelines) requires that under these circumstances "CEQA Findings" and overriding considerations be adopted by all agencies considering elements of the project which could result in significant impacts, I NOW, THEREFORE, BE IT RESOLVED that: 1. The Commission finds that in accordance with the attached "Candidate CEQA Findings all significant environmental .impacts have been mitigated through project design or other activities associated with the Specific Plan as i denti fi ed i n the Final EIR with the exception of Water Supply (reference EIR-85-1, Section 3.9.1) and Visual Quality (reference EIR-85-1, Section 3.3), 2. Any changes or alterations necessary to avoid or substantially reduce (I impacts relevant to the supply of water for the project are under the jurisdiction of the Sweetwater Authority and- not the City of Chula Vista, jl, and that 3. In accordance with the attached CEQA Findings the avoidance of significant Visual impacts can only be achieved through the implementation of the "no project" alternative which is not feasible to carry out because it would not be consistent with the adopted Land Use Plan of the Chula Vista Local Coastal Program nor would it provide the necessary tax base to support the Bayfront Redevelopment District. AND, BE IT FURTHER RESOLVED that: ~i i The City Planning Commission of the City of Chula Vista hereby adopts the attached Statement of Overriding Considerations as its statement of facts which warrant approval of the proposed project in light of the significant environmental impacts which cannot be feasibly avoided. ~ I PASSED AND APPROVED by the City Planning Commission of Chula Vista, California, this 9th day of January, 1965, by the following vote, to-wit: AYES: Cannon, Carson, Green, Guiles, O'Neill, Shipe and Tugenberg NOES: None ABSENT: None ~ti ~ is ae Teen, airman ATTEST: Ruth M.
