GPA 10-04/PCM 10-12 RESOLUTION OF THE CITY OF CHULA VISTA PLANNING COMMISSION RECOMMENDING THAT THE CITY OF CHULA VISTA CITY COUNCIL APPROVE 1) A RESOLUTION AMENDING CERTAIN SECTIONS OF THE CHULA VISTA GENERAL PLAN LAND USE AND TRANSPORTATION AND ENVIRONMENTAL ELEMENTS; 2) AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHULA VISTA MUNICIPAL CODE TITLE 19; AND 3) A RESOLUTION APPROVING A NEW COUNCIL POLICY; ALL REGARDING ESTABLISHMENT OF REGULATIONS AND REQUIREMENTS FOR THE SITING OF ELECTRICAL GENERATING FACILITIES WITHIN THE CITY OF CHULA VISTA WHEREAS, in February 2010, the C',ity Council directed staff to prepare amendments to the General Plan and Zoning Ordinance related to the siting of Electrical Generating Facilities (EGFs); and WHEREAS, pursuant to council direction, the Development Services Department convened a team consisting of interested members of the original 2005 Chula Vista General Plan Update (GPU) Environment, Open Space, and Sustainable Development Subcommittee (the "EGF Working Group"); and WHEREAS, the Development Services Department initiated a review of the City's General Plan and Zoning Ordinance to determine what sections needed to be amended related to the siting of EGFs; and i WHEREAS, the Development Services Department and the EGF Working Group have worked together to develop regulations and siting criteria for EGFs within Chula Vista including drafting a new EGF Council Policy to address the siting of EGFs (the "Project"); and WHEREAS, the Project documents represent the collective efforts of the Development Services Department and the EGF Working Group, and provides necessary criteria and !i regulations for the siting of EGFs within the City of Chula Vista; and WHEREAS, the Project reflects sound planning principles and is internally consistent with the General Plan; and WHEREAS, on May 9, 2011, staff presented the Project documents to the Resource Conservation Commission (RCC) for consideration and recommendation to the City Council, and obtained input from the RCC; and WHEREAS, the RCC, upon review of the Project recommended that the City Council adopt the Project with certain clarifying revisions that have been incorporated into the Project documents; and Planning Commission Resolution GPA 10-04 PCM 10-12 Page 2 WHEREAS, on May 31, 2011, staff presented the Project documents to the Council Energy Subcommittee (CES) for consideration and recommendation to the City Council, and obtained input from the CES; and WHEREAS, the CES, upon review of the Project recommended that the City Council adopt the Project with certain clarifying revisions that have been incorporated into the Project documents; and WHEREAS, the Development Services Director has reviewed the proposed Amendments for compliance with CEQA and has determined that there is no possibility that the activity, adopting a General Plan amendment and Zoning Code amendment may have a significant effect on the environment because the new General Plan policy and Zoning Code provisions will result in more stringent requirements for locating an Energy Generating Facility than currently exist, Therefore, pursuant to Section 15061(b)(3) of the State CECtA Guidelines the activity is not subject to CEQA, Thus, no environmental review is necessary. Although environmental review is not necessary for the General Plan Amendment and Zoning Code change, environmental review will be required for any Energy Generating Facilities that are proposed as part of the conditional use permit evaluation for that specific project; and WHEREAS, a hearing time and place was set by the Planning Commission for consideration of the Project and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City, at least ten (10) days prior to ~ the hearing; and WHEREAS, the Planning Commission held a duly noticed public hearing to consider said Project at the time and place as advertised, namely August 10, 2011 at 6 p m in the Council Chambers, 276 Fourth Avenue, and said hearing was thereafter closed NOW, THEREFORE, BE IT RESOLVED that the Planning Commission hereby recommends that the City of Chula Vista City Council approve the following: Attachment 1) draft City Council resolution amending various sections of the Chula Vista General Plan, Attachment 2) draft City Council ordinance amending various sections of Chula Vista Municipal Code Title 19, and Attachment 3) draft City Council resolution approving a new Council Policy -Electrical Generating Facilities; all regarding establishment of regulations and requirements for the siting of EGFs within the City of Chula Vista and all attached hereto and made a part hereof this resolution, BE IT FURTHER RESOLVED THAT a copy of this resolution be transmitted to the City Council Planning Commission Resolution GPA 10-04 PCM 10-12 Page 3 PASSED AND APPROVED BY THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA, this 10`h day of August, 2011, by the follo~.ving vote, to-wit: AYES: Spethman, Liuag, Vinson, Moctezuma NOES: Felber ABSENT: ABSTAIN: Presented by: Approved as to form y: Gary alb r P.E., AICP ~ le Assistant Manager/Development Services Directo ney Michael Spethman, Chair ATTEST: ~ II Diana Vargas, Secretary'
