SUMMARY
In accordance with the emergency provisions of Sectiori 1009 of the City Charter, City staff
contracted the services of Burtech Pipeline, Inc. (General Engineering Contractor License No.
718202) for. the repair of the emergency sewer facility on Third Avenue between "H" Street and
Whitney Street. An Informational Item was submitted on November 27, 2012 (Attachment 1)
indicating that staff would report back to City Council after the full cost of the emergency repair
project was identified.Repair work was completed on February 15, 2013. This report presents
the total expenditures for the emergency repair work.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that the emergency repair
project and related proposed fiscal/administrative activities fall under the statutory exemption
pursuant. for Emergency Projects in accordance with Section 15269 (b) and (c) of the State
CEQA Guidelines because the project involved emergency repair actions to public sewer
facilities to prevent or mitigate an imminent threat to life and property. The proposed activities

will assist in ratifying said emergency repair work. Thus, no further environmental review is
required
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
On October 11, 2012, Public Works Operations staff informed Public_Works Engineering staff
that the existing vitrified clay pipe (Pipe ID # 5566 flows from MH3352 to MH5427) at the
intersection of Third Avenue and `H' Street had holes and structural damage to several segments
of the pipe within Third Avenue between `H' Street and Whitney Street.
Based on the assessment of this sewer line, City staff concluded that rehabilitation must be
performed immediately, on an emergency basis, due to imminent threat to public safety and to
public and private property. If the sewer pipeline were not immediately repaired, failure of any
portion of this sewer line would have led to the undermining of the roadway and potential risk to
public safety and/or damage to public and private property.
The Director of Public Works and the City Manager agreed with staffs recommendation to
proceed with emergency repairs under the provisions specified in Section 1009 of the City,
Charter.
In accordance with City Charter Section 1009, and based upon the urgent necessity for the
preservation of life, health and property, City staff solicited three informal bids and contracted
the services of the lowest responsive bidder, Burtech Pipeline, Inc., to repair the distressed sewer
facilities.
Approval of the resolution would: (a) amend the FY12/13 CIP budget and establish new CIP
Project "Emergency Sewer Rehabilitation on Third Avenue between `H' Street and Whitney
Street (SW279)"; (b) accept the final report of expenditures for the ``Emergency Sewer
Rehabilitation on Third Avenue between `H' Street and Whitney Street (SW279)"; (c) reduce the
SW271, "Sewer Rehabilitation, FY 2011-12" CIP budget by $152,000 and appropriate the
equivalent amount to SW279; (d) make a finding that an emergency existed; and, (e) ratify the
contract with Burtech Pipeline, Inc for said emergency repair work. A breakdown of the total
costs is provided under ``Current Year Fiscal Impact."
Contractor Selection Process
Staff prepared bid documents and solicited three informal bids from qualified contractors that
had previously worked for the City of Chula Vista on sewer rehabilitation projects. On
December 21, 2012 the City received the following three proposals:

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found rio property holdings
within 500 feet of the boundaries of the property which is the subject of this action. Staff is not
independently aware, nor has staff been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
There is no direct impact to the General Fund as there are sufficient Sewer Facility Replacement
funds available in CIP- SW271, "Sewer Rehabilitation, FY 2011-12" CIP project to fund the
emergency repair work associated with CIP SW279. A summary of the project costs is as
follows:

Severely deteriorated corrugated metal pipe (i`CMP") and corrugated metal pipe azch ("CMPA") ,
have been discovered within the storm drain system on "E" Street at its .intersection with Fourth
Avenue, and have already failed or are in imminent danger of failure, based upon closed. circuit "
television (CCTV) inspection performed by City crews. Because failure has already occurred
within the system,. immediate action is required to avoid damage to City and private
infrastructure.
This storm drain system was constructed in 1975 and has now reached or exceeded its practical
service life. Public Works Operations repaired one pipe segment (Featured ID 10724) on [he
north side of the road under the Bus Stop azea. The system is shallow and has other potential
areas that could fail due to the inherent weakness of the deteriorated pipe and heavy traffic
loading. Public Works Operations staff has taken precautionazy measures where deemed
necessary to provide protection and safety in the interim until permanent repairs are
implemented.
Because of the advanced deterioration of this portion of the storm drain system; staff
recommends that rehabilitation be performed immediately, on an emergency basis,. due to
imminent threat to public safety and public and private property. Further, because of contractor
mobilization costs and the advanced age of the CMP storm drain system in this area, staff
proposes to rehabilitate the entire system within this major intersection at this time at a total
estimated cost of $275,000.
Due to heightened awareness of significant corrugated metal pipe (CMP) failures throughout San
Diego County in 2004 and 2005, on Mazch 22, 2005, the City contracted with Hirsch &
Company Consulting Engineers to evaluate the condition of the approximately 88,000 lineal feet
of corrugated metal pipe (CMP) storm drain within the City. In November 2005, Hirsch &
Company delivered a prioritized CMP repair report listing all inspected CMPs, with the
associated recommended priority and recommended timing for the rehabilitation of each pipe
segment. Due to the conditions of the inspected pipes and the projected rates of deterioration of
these pipes, the consultant recommended that all pipes be replaced or structurally lined within
one to five yeazs of the report's submittal.

The November 2005 Hirsch report prioritized all CMP repair work as follows:

Much of the approximately 2,282 lineal feet of CMP identified as ."Priority 1" has :been
rehabilitated, largely due to funding provided to the City through the Federal Department of
Housing and Urban Development. However, very little of the CMP under Priorities 2; 3 and 4,
totaling approximately 33,993 Lineal feet, has been addressed due [ti budget constraints and the
" lack of dedicated fimding for CMP rehabilitation and drainage projects.- As a result, CMPs in
Priorities 2, 3, and 4 are currently rehabilitated on an emergency basis. only as failures occur,
which is costly and inefficient compared with performing rehabilitation on a prescribed priority
schedule. Further, without a dedicated titnding source to rehabilitate these pipes and with'the
passage of time, the rates of CMP deterioration .and failure will continue to increase into the
foreseeable fiiture.
With your concurrence, staff will solicit tlu~ee informal bids from 'at least tluee qualified
contractors and perform this stornr drain rehabilitation work on an emergency' basis in
accordance with provisions in Section 1009 of the City Charter in order to assure the protection
of the public and of public and private property. An emergency contract will be let out fo the
low bidder out of the three solicited contractors. The design work is currently underway.
I+ISCAL IMPACT
There are no direct or dedicated funding sources for the maintenuice and repair of storm drain
facilities. .This Project will use an estimated total of $275,000 from GIP Project No. DR193,
Emergency Storm Drain Replacement at Various Locations allocated is the CIP FY 12/13
(Transnet Funds).
Staff will return with a Council Agenda item to report final emergency repair costs and to
appropriate funds, as necessary.

yearly Sewer Rehabilitation Program throughout the City; and
WHEREAS, the repair was completed on February 1 ~, 2013. An Informational Item was
submitted on November 27, 2012, with the plan to report back to City Council after the full cost
of the project was identified.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby amend the FY12/13 CIP budget and establish new CIP Project "Emergency
Sewer Rehabilitation on Third Avenue between `H' Street and Whitney Street (SW279)"; accept
the final report of expenditures for the "Emergency Sewer Rehabilitation on Third Avenue
between `H' Street and Whitney Street (SW279)"; reduce the SW271, "Sewer Rehabilitation, FY
2011-12" CIP budget by $152,000 and appropriate the equivalent amount to SW279; make a
