SUMMARY
In accordance with the emergency provisions of Section 1009 of the City Charter, City staff
contracted the services of Arrieta Construction, Inc. (General Engineering Contractor License
No. 259145) for the repair of distressed storm drain facilities located at "E" Street and Fourth
Avenue. An Informational Item was submitted on November 30, 2012 (Attachment 1) indicating
that staff would report back to City Council after the full cost of the emergency repair project
was identified. Repair work was completed on February 27, 2013. This report presents the total
expenditures for the emergency repair work.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that the emergency repair
project and related proposed fiscal/administrative activities fall under the statutory exemption
pursuant for Emergency Projects in accordance with Section 15269 (b) and (c) of the State
CEQA Guidelines because the project involved emergency repair actions to public storm drain
facilities to prevent or mitigate an imminent threat to life and property. The proposed activities

will assist in ratifying said emergency repair work. Thus, no further environmental review is
required.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
Severely deteriorated sections of corrugated metal pipe (CMP) and corrugated metal pipe arch
(CMPA) were discovered within the storm drain system on `E' Street at its intersection with
Fourth Avenue. Portions of this storm drain system had failed and other were in imminent
danger of failure, based upon closed circuit television (CCTV) inspection performed by City
Public Works crews. Because failure had already occurred within the system and additional
failure was imminent, immediate action was required to avoid damage to public and private
infrastructure.
This storm drain system was constructed in 1975 and has now reached or exceeded its practical
service life. Public Works Operations had previously repaired one pipe segment (Feature ID
10724) on the north side of the road under the Bus Stop area. Because the storm drain system at
this intersection is relatively shallow, additional CMP failure was highly likely due to the
inherent weakness of the deteriorated pipe and heavy traffic loading. Public Works Operations
took temporary measures where necessary to provide protection and safety in the interim until
permanent storm drain system repairs could be implemented.
Because of the advanced deterioration of this portion of the storm drain system, staff
recommended that rehabilitation be performed immediately, on an emergency basis, due to
imminent threat to public safety and public and private property. Further, because of contractor
mobilization costs and the advanced age of the CMP storm drain system in the area, staff
proposed to rehabilitate the entire system within this major intersection at the same time at a total
estimated cost of $275,000.
The Director of Public Works and the City Manager agreed with the recommendation of staff on
the necessity of proceeding with the emergency repairs at this location under the provisions
specified in Section 1009 of the City Charter.
In accordance with City Charter Section 1009, and based upon the urgent necessity for the
preservation of life, health and property, City staff solicited three informal bids and contracted
the services of the lowest responsive bidder, Arrieta Construction, Inc., to repair the storm drain
facilities.
The approval of the resolution would: (a) amend the FY12/13 CIP budget and establish new CIP
Project "Emergency Storm Drain Repairs at `E' Street and Fourth Avenue (DR194)"; (b) accept
the final report of expenditures for the "Emergency Storm Drain Repairs at `E' Street and Fourth

Avenue (DR194)"; (c) reduce the DR193, "Storm Drain Pipe Rehabilitation Project 'for FY
2013," CIP budget by $165,000 and appropriate the equivalent amount to DR194; (d) make a
finding that an emergency existed; and (e) ratify the contract with Arrieta Construction, Inc for
said emergency repair work.. A breakdown of the total costs is provided under "Current Year
Fiscal Impact."
Contractor Selection Process
Staff prepared and solicited three informal bids from qualified contractors that had previously
worked for the City of Chula Vista on storm drain rehabilitation projects. On December 21,
2012, the City received the following three proposals:

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the property which is the subject of this action. Staff is not
independently aware, nor has staff been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
There is no direct impact to the General Fund as there are sufficient TransNet funds available in
DR193, "Storm Drain Pipe Rehabilitation Project for FY 2013," CIP budget to fund the
emergency work associated with DR914. The DR193 project was established in the FY 2012-13
CIP budget for emergency replacement of failed storm drains, primarily corrugated metal pipes,
throughout the City. A summary of the DR194 emergency repair costs is as follows:

SUBJECT: Emergency Sewer Rehabilitation on Third Avenue between "H" Street and
Whitney Street in the City of Chula Vista, CA (CIP No. SW279)
As part of the ongoing program to rehabilitate the sewer system throughout the City, a priority
list is developed each year to guide the City's sewer rehabilitation efforts. On October 11, 2012
Public Works Operations staff informed Public Works Engineering staff that the existing
vitrified clay pipe (Pipe ID # 5566 flows from MH3352 to MH5427) at the intersection of Third
Avenue and H Street has a hole and several segments of the pipe within Thitd Avenue between
H Street and Whitney Street have varying degrees of distress. Therefore, the existing sewer is in
need of immediate emergency repair.
Based on the assessment of this sewer line, City staff concluded that that rehabilitation must be
performed immediately, on an emergency basis, due to imminent threat to public safety and to
public and private property. If the pipe is not immediately repaired, failure of any portion of this
sewer line could lead to the undermining of the roadway and potential risk to public safety and/or
damage to public and private property.
With your concurrence, staff will solicit three informal bids from at (east three qualified
contractors and perform this sewer rehabilitation work on an emergency basis in accordance with
provisions in Section 1009 of the City Charter in order to assure the protection of the public and
of public and private property. An emergency contract will be let out to the low bidder out of the
three solicited contractors. The design work is cun•ently underway.
FISCAL IMPACT
This Project will use an estimated total of $300,000 from CIP Project No. SW271; Sewer
Rehabilitation Program allocated in the CIP FY 11/12 (Sewer Facility Replacement Fund). This
estimate includes constmction and City staff cost.
Staff will return with a Council Agenda item to report final emergency repair costs and to
appropriate funds, as necessary.

expenditures for the ``Emergency Storm Drain Repairs at `E' Street and Fourth Avenue
(DR194)"; reduce the DR193, "Storm Drain Pipe Rehabilitation Project for FY 2013," CIP
budget by $165,000 and appropriate an equivalent amount to DR194; make a finding that an
emergency existed, and ratify the contract with Arrieta Construction, Inc for said emergency
repair work.
