PCM-04-10 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA RECOMMENDING THAT CITY COUNCIL AMEND CHULA VISTA MUNICIPAL CODE CHAPTER 19,56 BY ADOPTING MUNICIPAL CODE SECTION 19.56,300 ENTITLED HISTORIC PRESERVATION MODIFYING DISTRICT- PURPOSE; AND SECTION 19.56.310 HISTORIC PRESERVATION MODIFYING DISTRICT- APPLICATION WHEREAS, in 2007 City Council directed staff to develop a Historic Preservation Program that would protect the City's historical resources; and WHEREAS, staff developed a Historic Preservation Program and Ordinance that allows for the designation of both individual properties and Historic Preservation Districts; and WHEREAS, preservation of designated historic districts and the story they tell may be accomplished, in part, by providing flexibility of zoning regulations; and i i WHEREAS, the Historic Preservation Program and Ordinance would allow for a Historic Preservation Modifying District, to be applied to properties within a designated Historic Preservation District to allow for flexibility of zoning regulations; and WHEREAS, said Modifying District shall revise certain, otherwise applicable, regulations of the underlying zone; and WHEREAS, Chula Vista Municipal Code section 19,12 020 requires that the Planning Commission make a recommendation to the City Council on amendments or changes to the regulations of the Zoning Code; and WHEREAS, the amendments to the Chula Vista Municipal Code reflect sound planning i principles that are internally consistent with the adopted General Plan; and WHEREAS, the Development Services Director has reviewed the proposed project for i compliance with the California Environmental Quality Act (CECW) and has determined that the project qualifies for Class 31 and Class 8 Categorical Exemptions pursuant to Section's 15331 and 15308 (Historical Resource Restoration/Rehabilitation and Actions by Regulatory Agency for Protection of the Environment) of the State CECW Guidelines because it adopts regulations which allow for preservation of designated historic districts and resources in the City of Chula Vista. Thus, no further environmental review is required, WHEREAS, a hearing time and place was set by the Planning Commission for consideration of the Project and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City, at least ten (10) days prior to the hearing; and Planning Commission Resolution PCM-04-10 Page 2 WHEREAS, the Planning Commission held a duly noticed public hearing to consider said Project at the time and place as advertised, namely May 25, 2011 at 6 p m in the Council Chambers, 276 Fourth Avenue, and said hearing was thereafter closed. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommend that the City of Chula Vista City Council approve the attached City Council Ordinance to amend Chula Vista Municipal Code Chapter 19.56 by adopting Chula Vista Municipal Code section 19 56 300 entitled Historic Preservation Modifying District- Purpose; and Section 19.56.310- Historic Preservation Modifying District- Application on the condition precedent that the City Council adopt the Historic Preservation Ordinance and Program Should the City Council not adopt the Historic Preservation Ordinance and Program then this Planning Commission resolution is void ab initio BE IT FURTHER RESOLVED THAT a copy of this resolution be transmitted to the City Council PASSED AND APPROVED BY THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA, this 25th day of May, 2011, by the following vote, to-wit: AYES: Spethman, Liuag, Bringas, Tripp, Felber NOES: Vinson ABSENT: Moctezuma I ABSTAIN: Presented by: Approved as to for ~ ~ - i Gary alb t P E, AICP n I Assistant i Manager/Development Services Director City, o Michael Spethman, Chair ATTEST: s -w Diana Vargas, Secre, ry
