PCZ-04-O1 and SUPS O4-07 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA RECOMMEDING THAT CITY COUNCIL APPROVE A REZONE (PCZ-04-O1) FOR A CHANGE FROM THOROUGHFARE COMMERCIAL/PRECISE PLAN (CTP) ZONE TO CENTRAL COMMERCIAL/PRECISE PLAN (CCP) ZONE ALONG WITH PRECISE PLAN STANDARDS AND THAT THE REDEVELOPMENT AGENCY ADOPT A MITIGATED NEGATIVE DECLARATION (IS-03-0.34) AND APPROVE SPECIAL USE PERMIT (SUPS O4-07) ALLOWING THE DEVELOPMENT OF A RESIDENTIAL AND OFFICE COMMERCIAL MIXED-USE PROJECT LOCATED AT 10.30/1034 BROADWAY.. WHEREAS, a duly verified application for a Rezone was filed on July 25, 2003, and a duly verified application for a Special Use Permit was filed on April 23, 2004, with the City of Chula Vista Planning Department by Cazlos Madrazo "Developer"; and WHEREAS, said Developer requests approval of the Rezone and a Special Use Permit to allow for amixed-use project that includes 30 condominium units, 5,000 square feet of office pace, open space and off-street parking., The project site is located in a Thoroughfare Commercial (C-T) zoning district; and i WHEREAS, the Environmental Review Coordinator, has reviewed the proposed project for compliance with the California Environmental Quality Act and has conducted an Initial Study, IS-03-034 in accordance with the California Environmental Quality Act. Based upon the i results of the Initial Study, the Environmental Review Coordinator has determined that the i project could result in significant effects on the environment. However, revisions to the project made by or agreed to by the applicant would avoid the effects or mitigate the effects to a point where clearly no significant effects would occur; therefore, the Environmental Review Coordinator has prepared a Mitigated Negative Declaration, IS-0.3-034; and. WHEREAS, the Planning Director set the time and place for a heazing on said Rezone (with precise plan standards) and Special Use Permit and notice of'said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the City and its mailing to property owners and residents within 500 feet of the exterior boundaries of the property at least 10 days prior to the hearing; and WHEREAS, the hearing was held at the time and place as advertised, namely June 16, 2004, at 6:00 p m in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said heazing was thereafter closed; and WHEREAS, after considering all reports, evidence, and testimony presented at said public heazing with respect to the conditional use permit application, the Planning Commission voted to recommend adoption of the Mitigated Negative Declaration (IS-03-034) and approval of the Rezone (PCZ-04-O1) and Special Use Permit (SUPS O4-07); and Resolution No, PCZ-04-O1 and SUPS-04-07 Pale 2 NOW, THEREFORE, BE II RESOLVED THAT THE PLANNING COMMISSION does hereby recommend that the City Council adopt the draft Ordinance for Mitigated Negative Declaration (IS 03-034) and Rezone (PCZ 04-01) and recommends that the Redevelopment Agency adopt the draft Resolution for Special Use Permit (SUPS O4-07) in accordance with the findings and subject to the conditions contained therein„ BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the Redevelopment Agency and the Developer.
