HomeMy WebLinkAboutPCZ 2012-02 RESOLUTION NO PCZ-12-02 RE,SOLUIION OF THE CIIY OF CHULA VISIA PLANNING COMMISSION RECOMMENDING IHAI IHE, CIIY COUNCIL DENY IHE REQUESI 10 AMEND IHE ZONING MAP ' ESIABLISHED BY CHULA VISIA MUNICIPAL CODE SECIION 19.18.010 IO REZONE SAID PARCELS LOCAIED IN IHE 600 BLOCK ON IHE WESI SIDE OF SECOND AVENUE FROM SINGLE-F AMILY RESIDENIIAL (Rl -7) ZONE IO R1-15 WHEREAS, on November 1, 2011 the Chula Vista City Council directed the Development Services Department to initiate a rezone of the west side of the 600 block of Second Avenue ("Project Site"), to change the zoning from R1=7 to R1-15; and WHEREAS, the Development Services Department requests approval of an amendment to the adopted zoning map or maps established by Section 19 18 010 of the Chula Vista Municipal Code in order to rezone the Project Site from Rl-7 to R1-15 ("Project"); and WHEREAS, the Project Site, which is the subject matter of this Resolution, and is depicted in Exhibit "A," attached hereto and incorporated herein by this reference, consists of 21 parcels located on the west side of'the 600 block of Second Avenue; and i WHEREAS, the Development Services Director has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that if approved there is no possibility that the activity may have a significant effect on the environment because the activity would result in a less intensive land use than allowed under existing zoning; therefore, pursuant to Section 15061(b)(3) ofthe State CEQA Guidelines the activity is not subject to 1 CEQA Thus, no environmental review is required; and WHEREAS, the Development Services Director set the time and place for a hearing on the i Project, and notice of said hearing, together with its purpose, was given by its publication in a newspaper ofgeneral circulation in the city and its mailing to property owners within 500 feet ofthe exterior boundaries of the property, at least 10 days prior to the hearing; and i WHEREAS, the hearing was held at the time and place as advertised, namely 6:00 p.m., March 14, 2012, in the Council Chambers, 2'76 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed; and WHEREAS, the Planning Commission having received certain evidence on March 14, 2012, as set forth in the record of its proceedings therein, as set forth in their recommending Resolution PCZ-12-02, recommends that the City Council deny the Project. Planning Commission Resolution - PCZ 12-02 Page 2 NOW, IHEREFORE, BE II RESOLVED THAI IHE PLANNING COMMISSION recommends that the City Council not amend the Zoning Map established by CVMC Section 19.18.010 to rezone 21 single family lots located in the 600 block and on the west side of Second Avenue from an existing Single-Family Residential (Rl-7) Zone to aSingle-Family (R1-15) Zone, BE IT FURIHE,R RESOLVED IHAI a copy ofthis Resolution be transmitted to the City Council..
