A RESOLUIION OF IHE PLANNING COMMISSION
OF THE CIIY OF CHULA VISIA GRANIING A IWO
YEAR TIME EXPANSION FOR CONDIIIONAL USE
PERMIT IO ALLOW IHE RENOVATION AND
EXPANSION OF AN EXISTING CHURCH/SCHOOL
FACILIIY KNOWN AS Si, ROSE OF LIMA
CAIHOLIC PARISH LOCAIED AI IHE NORTHEAST
CORNER OF IHIRD AVENUE. AND "H" STREEL
WHEREAS, a duly verified application for a Conditional Use Permit was filed
with the City of Chula Vista Planning and Building Department on ,January 13, 2006 and
September 21, 2006 respectively, by St Rose of Lima Catholic Parish. ("Applicant"); and
WHEREAS, the application requested approval of a Conditional Use Permit
(PCC-06-042) to allow the renovation and expansion of the existing church campus in
three construction phases (Project); and i
WHEREAS, the Planning Commission held an advertised public hearing on the
Project on June 2'7, 2007, and after hearing staff presentation and public testimony, voted
4-0-3-0 to recommend that the City Council approve the Project, in accardance with the
findings and subject to the required conditions of approval; and
WHEREAS, the City Council approved said conditional use permit ou July 17,
2007; and
WHEREAS, Section 19 14.260 of the Municipal Code states that a conditional
use permit shall be conditioned upon the privileges granted being utilized within one year
from the effective date thereof; and
WHEREAS, Section 19 14.260 further states that the Planning Commission, may
by resolution, grant an extension of time contained in a currently valid conditional use
permit without a pubic hearing subject to the finding of no material changes or
ciroumstances since the granting of the permit which would be injurious to the
neighborhood or otherwise detrimental to the public welfare; and
WHEREAS, on April 30, 2008, the applicant requested a one year time extension,
in that the construction of Phase I of the project was delayed due to Chapter Eleven
proceedings involving the Roman Catholic Diocese of San Diego which caused a delay in
the applicant's ability to move farvvard with any expenditures on this major construction
project; and
WHEREAS, Mitigated Negative Declaration ("MND") IS-06-01 i and the
accompanying Mitigation Monitoring Program, the Findings and Conditions of Approval
contained within City Council Resolution No 2007-191 are still valid, applicable and
enforceable, and that the applicant agrees thereto, and that City Council Resolution No
2007-191 is incorporated into this subject Planning Commission Resolution by reference;
and
WHEREAS, at the Planning Commission meeting of July 9, 2008, the
Commission voted unanimously to extend the period of time fox granting an extension
from one year to two years in order to allow for any unforeseen future delays; and '
WHEREAS, the applicant believes atwo-year time extension will be sufficient to
allow for the commencement of the construction phase of the project
NOW, IHEREFORE, BE II RESOLVED, the Planning Commission hereby
finds that there have been no material changes or circumstances since the granting of
Conditional Use Permit PCC-06-042 that would be injurious to the neighborhood or
otherwise detrimental to the public welfare because 1) there have been no proposed
changes in operations of the church facility since the original granting of the Conditional
Use Permit; 2) the applicable zoning of the site has not been modified since approval of
this project; 3) the project remains consistent with the General Plan; and 4) there has been
no substantial change in intensification of the surrounding area.
BE II FURTHER RESOLVED that the Planning Commission approves atwo-
year time extension to the date of .July 17, 2010 based upon the above findings,
PASSED AND APPROVED BY THE PLANNING COMMISSION OF CHULA
VISIA, CAILIFORNIA, this 9`" day of .July, 2008 by the following vote, to-wit: II
