The budgets submitted at this time for formal adoption and appropriation represent the City Council's fiscal year 2013-14 proposed budgets. They reflect the City Council's proposed budget amended to reflect the addition of a Senior Park Ranger based upon input received at the May 28, 2013 City Council meeting and the addition of FA Geospatial Intelligence Analyst approved by the City Council on May 7, 2013. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed activity, Adoption and Appropriation of the City, Successor Agency to the Redevelopment Agency, and Housing Authority budgets for fiscal year 2013-14, for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it involves only the allocation of funding; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the acfivity is not subject to CEQA. RECOMMENDATION Staff recommends that the City Council/Successor Agency to the Redevelopment Agency/Housing Authority adopt Resolutions A-G, therefore approving their respective budgets for fiscal year 2013-14 and appropriating funds accordingly. Ordinance H -Staff recommends that the City Council, adopt the proposed changes with respect to the establishment of unclassified positions as described in Ordinance H and place the ordinance on first reading. BOARDS/COMMISSION RECOMMENDATION As required by the City Charter, the Parks and Recreation Commission considered the annual budget for parks and recreation and were afforded the opportunity to make recommendations to the City Council and City Manager. DISCUSSION Staff submitted the Fiscal Year 2013-14 Proposed Budget document to the City Council on May 24, 2013. As required by the City Charter, the City Manager's proposed budget was submitted to the City Council at least thirty-five days before the beginning of the fiscal year. The City Manager's Proposed Budget was presented at the City Council Meeting of May 28, 2013. Prior to accepting the City Manager's Proposed Budget, the City Council made a revision to add a Senior Park Ranger to the Public Works Department. With that amendment, the City Council accepted the City Manager's Proposed budget thus establishing the City Council's Proposed budget for fiscal year 2013-14. In accordance with 20-3 JUNE 11, 2011, Item 20 Page 4 of 8 the City Charter, a copy of the City Council's proposed budget was made available on May 31, 2013 for public review by making a hard copy of the budget available at the City Clerk's Office and the City Library, as well as posting a copy of the budget on the City's website. On May 28, 2013 Council took further action to set a public hearing on the budget for June 11, 2013. This report summarizes the City Council's proposed budget for fiscal year 2013-14, as amended to reflect the following: • The addition of 1.0 FA Geospatial Intelligence Analyst to the Police Grants Fund; the City Council approved the addition of this position on May 7, 2013. Due to timing issues, this position was not included in the City Manager's Proposed Budget document. • The addition of 1.0 Senior Park Ranger to the Public Works Department as proposed by the City Council at the City Council meeting of May 28, 2013. The budget presented in this staff report represents the proposed City Council budget for fiscal year 2013-14, which is now presented for final Council adoption and appropriation of funds. Attachment A, Recommended Expenditures by Department and Category, summarizes the City Council's proposed budget for fiscal year 2013-14. The Recommended Expenditures by Department and Category has been updated to reflect the addition of the two positions listed above. The final All Funds expenditure budget submitted for fiscal yeaz 2013-14 totals $268.8 million and includes a General Fund operating budget of $127.8 million. The All Funds budget for fiscal year 2013-14 also includes spending allocations for capital improvement projects totaling $15.4 million. The remaining $125.6 million represents the operating budgets for vazious funds including the Successor Agency to the Redevelopment Agency, Housing, Sewer, Development Services, Transit, Fleet, Debt Service, and Other Funds. Estimated All Funds revenues total $261.1 million, the Schedule of Revenues is included as Attachment B. The total number of recommended permanent positions is 950.0 positions citywide; the Proposed Staffing by Department/Fund for fiscal year 2013-14 is included as Attachment C. Position Summary The City Council Proposed Budget for fiscal year 2013-14 reflects 950.0 positions citywide. This reflects a net increase of 17.65 when compared to the fiscal year 2012-13 Council adopted budget. 15.0 of the 17.65 positions were positions that the City Council approved during fiscal year 2012-13. There is a net increase of 2.65 positions recommended in the fiscal year 2013-14 budget. On May 28, 2013 the City Council considered the City Manager's Proposed Budget for fiscal year 2013-14. Prior to accepting the City Manager's Proposed budget the City Council modified the fiscal year 2013-14 proposed budget to include the addition of 1.0 Senior Park Ranger. In order to better align job responsibilities with job classifications, there are a number of new titles proposed to be added to the Compensation Schedule and Classification Plan. Due to timing issues this position was not reflected in the printed copy of the fiscal year 2013-14 proposed budget. 20-6 J[JNE 11, 2011, Item `-~ Page 7 of 8 Finally, Chula Vista Municipal Code Section 2.05.010 also needs to be updated to reflect the position changes impacting the unclassified positions. Chula Vista City Charter Section 500 requires that all unclassified positions not mentioned specifically in Charter Section 500 be adopted by ordinance. Adoption of the ordinance will add the position titles of Animal Care Facility Administrator and Housing Manager to Municipal Code Section 2.05.010. It should be noted that for administrative purposes, there are some position titles that are included in Chula Vista Municipal Code Section 2.05.010 but aze not included in the fiscal yeaz 2013-14 budget; these include the Assistant Chief of Police, CBAG Administrative Analyst I, CBAG Accounting Technician, CBAG Management Assistant, City Engineer, Purchasing Agent and Traffic Engineer. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council/Successor Agency to the Redevelopment Agency/Housing Authority members and has found that potential conflicts exist, in that, members have property holdings within 500 feet of the districts listed below: • City Council Conflicts: o Council Member Aguilar -Open Space District 8 (Fund 362). This conflict pertains to Resolution B. o Council Member Salas -Open Space District 10 (Fund 364) and the Non- Departmental Other Expenses Category in the General Fund. The conflict in the Non-Departmental budget relates to the budget appropriation for the Third Avenue Property Based Business Improvement District (PBID). These conflicts pertain to Resolutions C and D, respectively. Each of the remaining decisions contemplated by this action is either: (i) not site specific; or (ii) ministerial, secretarial, manual, or clerical in nature, thus, not requiring the members to make or participate in making a governmental decision, pursuant to California Code of Regulations Title 2, section 18702.4(a); or (iii) solely concerns the repair, replacement or maintenance of existing streets, sewer, storm drainage or similar facilities and, as such, the financial effect of the decision on real property is presumed not to be material, pursuant to California Code of Regulations Title 2, sections 18704.2(b)(2) and 18705.2(b); or (iv) , to the extent the decision may have a material effect a member's economic interests, it will not impact those interests differently than it will those of the public generally and, thus, pursuant to California Code of Regulations Section 18707.1, the economic effect on the public officials is considered indistinguishable from that of the public generally. Consequently, these decisions do not present conflicts under the Political Reform Act (Cal. Gov't Code § 87100, et seq. ) Staff is not independently aware, nor has staff been informed by any City Councilmember, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. 20-7 JUNE 11, 2011, Item ~-~ Page 8 of 8 CURRENT YEAR FISCAL IMPACT There is no fiscal impact in the current fiscal year. ONGOING FISCAL IMPACT Approval of the proposed budgets will result in the appropriation of $268.8 million in funding for the fiscal year ending June 30, 2014. This amount includes a General Fund budget of $127.8 million. The General Fund was balanced with the use of $2.3 million from the Economic Contingency Reserve. RESOLUTION OF THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA ADOPTING THE OPERATING BUDGETS FOR THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY FOR FISCAL YEAR 2013-14 AND APPROPRIATING FUNDS FOR THE FISCAL YEAR ENDING JUNE 30, 2014 WHEREAS, the City Council of the City of Chula Vista received and considered the City Manager's proposed operating and capital improvement budget for the City of Chula Vista for the fiscal year ending June 30, 2014; and WHEREAS, the City Manager's Proposed Budget for fiscal year 2013-14 was distributed on May 24, 2013 and presented at the May 28, 2013 Joint Meeting of the City Council, Housing Authority, and Successor Agency to the Redevelopment Agency; and WHEREAS, at the May 28, 2013 Joint Meeting, the City Council/Successor Agency to the Redevelopment Agency/and Housing Authority accepted the operating and capital improvements budgets for the City of Chula Vista for fiscal yeaz 2013-14 as their proposed budgets revised to include the addition of a Senior Park Ranger to the Public Works Department, respectively; and WHEREAS, the proposed budget for fiscal year 2013-14 was also revised due to the addition of a FA Geospatial Intelligence Analyst to the Police Grants fund approved by the City Council at the May 7th City Council Meeting; and WHEREAS, the City Council's revisions were incorporated into the proposed budget and, in accordance with the City Charter, the revised budget was made available for public inspection as of May 31, 2013, and a public heazing was set for June 11, 2011; and WHEREAS, the Successor Agency to the Redevelopment Agency of the City of Chula Vista received and considered the City Manager's proposed operating budgets, including the Successor Agency's operating budgets, for the City of Chula Vista for the fiscal year ending June 30, 2014; and WHEREAS, the Successor Agency's operating budgets submitted at this time for formal adoption and appropriation represents the Successor Agency's final proposed operating budgets, as presented in the Fiscal Yeaz 2013-14 Proposed Budget document, amended to reflect various clean up items; and WHEREAS, a copy of the Successor Agency's budget document is on file in the Office of the City Clerk; and J:\Attomey\FINAL RESOS AND ORDINANCES\2013\06 11 13\FYl4 Finance -Resolution G.doc 6/5/2013 8:16 AM 20-48 Resolution No. Page 2 WHEREAS, a public heazing on the City's proposed operating budgets, including the Successor Agency's operating budgets, was noticed and held as required by the City Charter, and all public testimony was received and considered. NOW, THEREFORE, BE IT RESOLVED by the Successor Agency to the Redevelopment Agency of the City of Chula Vista that it adopts the Operating Budgets for the Successor Agency to the Redevelopment Agency for Fiscal Year 2013-14, as presented and on file in the Office of the City Clerk. BE IT FURTHER RESOLVED by the Successor Agency to the Redevelopment Agency of the City of Chula Vista that it approves the appropriation of funds for the fiscal yeaz ending June 30, 2014 as described in the Proposed Expenditures by Department/Category report, as presented and on file with the City Clerk's Office. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 2.05.010 RELATING TO THE ESTABLISHMENT OF UNCLASSIFIED POSITIONS TO ADD ANIMAL CARE FACILITY ADMINISTRATOR AND HOUSING MANAGER WHEREAS, the City Council ofthe City of Chula Vista received and considered the City Manager's proposed operating and capital improvement budget for the City of Chula Vista for the fiscal year ending June 30, 2014; and WHEREAS, the City Manager's Proposed Budget for fiscal year 2013-14 was distributed on May 24, 2013 and presented at the May 28, 2013 Joint Meeting of the City Council, Housing Authority, and Successor Agency to the Redevelopment Agency; and WHEREAS, at the May 28, 2013 Joint Meeting the City Council/Successor Agency to the Redevelopment Agency/and Housing Authority accepted the operating and capital improvements budgets for the City of Chula Vista for fiscal year 2013-14 as their proposed budgets revised to include the addition of a Senior Park Ranger to the Public Works Department, respectively; and WHEREAS, the proposed budget for fiscal yeaz 2013-14 was also revised due to the addition of a FA Geospatial Intelligence Analyst to the Police Grants fund approved by the City Council at the May 7, 2013 City Council Meeting; and WHEREAS, City Council's revisions were incorporated into the proposed budget and, in accordance with the City Charter, the revised budget was made available for public inspection as of May 31, 2013, and a public hearing was set for June 11, 2011; and WHEREAS, a copy of the proposed budget document is on file in the Office of the City Clerk; and WHEREAS, the total number of recommended permanent positions is 950.00 for Fiscal Year 2013-14, a net an increase of 17.65 positions when compared to the fiscal year 2012-13 Council adopted budget; and WHEREAS, the recommended permanent positions for fiscal year 2013-14 includes three new position titles that will be in the unclassified service; and WHEREAS, the Human Resources Department has created new classifications to better reflect the needs of the City's workforce and to provide greater service to the community; and WHEREAS, Chula Vista City Charter Section 500(a) requires that all new unclassified management level positions be adopted by ordinance and afour-fifths vote of the Council. Severability If any portion of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid, unenforceable or unconstitutional, by a court of competent jurisdiction, that portion shall be deemed severable, and such invalidity, unenforceability or unconstitutionality shall not affect the validity or enforceability of the remaining portions of the Ordinance, or its application to any other person or circumstance. The City Council of the City of Chula Vista hereby declares that it would have adopted each section, sentence, clause or phrase of this Ordinance, irrespective of the fact that any one or more other sections, sentences, clauses or phrases of the Ordinance be declared invalid, unenforceable or unconstitutional. Publication The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to law.
