Corporation, and TRT .Oi1NTY ONSTRII TTON~TNC_ here- inafter called the Second Party, as follows: WI TNESSETH: WHEREAS, the Second Party is the owner of real property in the City of Chula Vista, County of San Diego, State of California, described as follows: That portion of the Northwest Quarter of Quarter.Section 111 of Rancho de la Nacion, according to Map thereof No. 166 filed in the office of the County Recorder of San Diego, California, May 11, 1869. WHEREAS, the Second Party proposes to.create a subd erty above described, to be known as RONTTA .OV S and to effect the same as heretofore filed with the of the said City of Chula Vista, the necessary maps plans and.other data in conformity with the laws of ornia and the ordinances of the City of Chula Vista and . ivision of the prop- T$DTpTSTON proper authorities and improvement the State of Calif- applicable thereto, h'F.EREAS, the said proper authorities of said City have found the pro- posed subdivision plan to be acceptable and in accord with the best interests of said City, and WHEREAS, the City of Chula Vista is entitled to require from'the Second ~~ Party, and does require from'the Second Party, as a~condition precedent j to the acceptance of any and all streets and easements and other improve ments, assurances for the completion of the public improvements in said ~ subdivision as is provided therefore in said plans and attendant speci- fications as have heretofore been approved as aforesaid, and ~ SUB-0-8 ~ ~~! ~ ' 1~~5~ 357d'81 -1- WHEREASa the Second Party is desirous of supplying such assurances, NOW, Tf'v^.REFORE, IT IS HEREBY AGREED BY and between the City of Chula Vista, and the Second Party as follows: to Said Second Party agrees to undertake and complete, and to pay for all labor and materials in connection therewith, within a period of 365 days from the date hereof, all the necessary work and installation of improvements in the hereinabove described subdivision in full conform- ity with the ordinance s, of the City of Chula Vista, the laws of the State of California, the directions ofproper officials of the City of Chula Vista, California, as may be applicable thereto, and the plans for such improvements on file in the office of the City Engineer of the City of Chula Vista, bearing the file numbers: Drawing No. 64-41 L through 64-46L inclusive The engineers estimate of cost o£ said improvements is $101.,745.40 10% contingencies 10 174.54 Total Bond Amount 5111,919.94 The execution of this contract automatically acknowledges by the Party of the Second Part, the responsiblity to guarantee all public improvements for a period of one (1) year from the date of final acceptance. The Second Party further agrees to indemnify, protect and hold harmless the said City of Chula Vista from any. and all claims of liability for personal injury, property damage, labor or material claims which may be made against the said City by reason of said work and installationof improvements as~herein provided. 2. As a guarantee and as security for its full and faithful perform= ante in complying with all the requirements for the completion of said subdivision as aforesaid, the said Second Party shall deliver to the City of Chula Vista upon the execution of this agreement, a good and sufficient improvement securit responsible financial institution h~c9t executed by a~.~C~€a~tSS~~#~ satisfactory to the said City of Chula Vista in the sum of $ 111 619.94 SUB-Q~S ._2_ 3. WHEREAS, subdivider presently is engaged in subdividing certain lands to be known as Bonita Cove Subdivision in the City -~ of Chula Vistain accordance with the contract for completion of ' improvements authorized by Resolution No. 3568 , and WFIERFIIS, subdivider does not desire to set durable monu- _~ ~ ments prior to the recordation of the final map of the subdivision, but desires that said monuments of the survey by Wittman Engineering will be set at a later date as per the final map of said sub- . ~ division, a copy of which is on.file with the City Engineer of the - ~ City of Chula Vista, reference to which said map is hereby made and same is incorporated herein as though here set forth in full . and according to the ordinances of the City of Chula Vista in force and effect at the time of giving of the security attached hereto as Exhibit A on or before the expiration of thirty (30) consecutive days following completion and acceptance of public improvements within said subdivision.
