SUMMARY
On May 29, 2013, the Director of Public Works received seven (7) sealed bids for the "Chula
Vista Golf Course Pedestrian Trail and Bridge Improvements in the City of Chula Vista, CA
(CIP No. PR318)" project. Bidders were directed to provide a bid for the installation of a
pedestrian bridge over the drainage channel north of the intersection of Otay Lakes Road and
Bonita Road (Base Bid), and to provide additive alternative bids to complete trail improvements
between from the bridge improvements to approximately 600 feet west (Additive Alternate Bid
"A") and for the installation of decorative railing at the top of the drainage channel's wall that
matches the bridge (additive Alternative Bid "B"). Funding for this project is a $185,000 County
of San Diego Neighborhood Reinvestment Program (NRP) Grant championed by Supervisor
Greg Cox.
The proposed resolution would accept bids, award a public works contract to Just Construction,
waive City Council Policy No. 574-01 regarding change order authorization limits, and authorize
the Director of Public Works to expend all available contingency funds in the project to complete
as many additive alternative bid items in the project as possible.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed project consisting of the
construction of a multi-use recreational trail bridge and disintegrated granite trail within a

developed City pazk for compliance with the California Environmental Quality Act (CEQA) and
has determined that this project qualifies for a Class 3 Categorical Exemption pursuant to Section
15303 [New Construction or Conversion of Small Structures] of the State CEQA Guidelines
because the proposed multi-use recreational trail bridge and disintegrated granite trail consist of
small facilities to be constructed within an existing public pazk and that the proposed project will
not result in damage to scenic resources, trees, historic buildings, rock outcroppings or similar
resources, nor will it impact sensitive environmental resources, nor is it near hazardous waste
sites, nor will it create hazazdous substances. Further, a Notice of Exemption for this project was
filed in the Office of the County Clerk on May 23, 2012. Thus, no further environmental review
is required.
RECOMMENDATION
Council adopt the resolution.

The basis for detennining the lowest responsive bidder, as specified in the bid documents, is the
base bid. Therefore, Just Construction's base bid of $104,000 is the lowest responsive bid and
staff, therefore, recommends awarding a base construction contract in the amount of $104,000 to

Just Construction. Further, Just Construction's base bid package is complete, with no errors or
omissions.
Just Construction provided references for projects of a similaz nature and staff has determined
that the contractor and its principals have performed satisfactorily on those projects and have
sufficient experience to install the prefabricated pedestrian bridge and perform the work required
under the contract. In addition, Just Construction is currently completing its first public works
contract with the City and their work has been satisfactory. Just Construction is a Licensed
General Engineering (Class A), General Building Contractor (Class B), and Concrete Contractor
(Class C-8) under California License No. 968910. Their license status is current and active per
the Department of Consumer Affairs' Contractors State License Boazd.
Additive Alternative Work
Because $175,000 of the NRP grant will be available for construction, staff intends to direct the
contractor to perform work under Additive Alternative Bid "A" and, if sufficient NRP Grant
funds remain, Additive Alternative Bid "B"; the remaining $10,000 will be used for geotechnical
and material testing services during construction.
In reviewing Just Construction's Additive Alternative Bid "A" for trail completion, staff noted
that Just Construction's bid price for disintegrated granite was significantly higher than the
second and third lowest bidders' prices -- all other bid prices for this additive alternative work
were generally consistent with the second and third lowest bids. In discussing the price bid for
disintegrated granite, Just Construction indicated that the supplier that bid this work is from
Corona, California and that much of the cost for this bid item can be attributed to trucking costs.
The City's Project Manager and Just Construction agreed to delete the bid item for disintegrated
granite in its entirety (as allowed by the contract specifications) and to either work with
contractor to utilize a local aggregate supplier or purchase the material directly through the
City's procurement process. Therefore, at minimum, the bridge and trail work will be completed
under the proposed public works contract.
Chance Order Authority
The proposed resolution would also authorize the Director of Public Works to approve change
orders over and above existing policy limits. Under City Council Policy No. 574-01, if an
individual change order causes the cumulative increase in change orders to exceed the Director's
authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is
required. The corresponding maximum aggregate contract increase that may be approved by the
Director of Public Works under Policy No. 574-01 is $10,280. Approval of the resolution would
increase the Director of Public Works' authority to approve change orders, as necessary, up to
the contingency amount of $71,000 (an increase of $60,720) over Policy No. 574-01 in order to
complete as many additive alternative bid items in the project as possible. Increasing the
contingency funds will also allow staff to continue the project without delay should unforeseen
circumstances resulting in increased project costs arise during the course of construction, as well
as to make adjustments to bid item quantities. Unforeseen conditions include such items as
utility conflicts, hazardous materials, other unexpected underground conditions, eta If any of
the contingency funds aze not used, then they will be returned to the County of San Diego.

Wage Statement
The source of funding for this project is the County of San Diego Neighborhood Reinvestment
Program (NRP) Grant Program and City General Fund staff services (grant match). Contractors
bidding this project aze not required to pay Federal and/or State of California general prevailing
wages to persons employed by them for the work under this project.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the property which is the subject of this action. Staff is not
independently aware, nor has staff been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
A breakdown of the project costs is as follows:

Sufficient funds aze available in the account balance of CIP Project No. PR318.
The City committed staff services to this project as a grant match. To date, City General Fund
staff costs have totaled approximately $16,000. A total of $45,000 in City General Fund staff
expenditures is anticipated through the completion of construction.
ONGOING FISCAL IMPACT:
Upon completion of the project, the improvements will require routine maintenance.

WHEREAS, in order to approve change orders as necessary to complete the project
without delay, staff requests that City Council waive Council Policy No. 574-01 and increase the
Director of Public Works' change order authority to $71,000, including quantity adjustments;
and authorize the expenditure of all available contingency funds in an amount not to exceed
$71,000.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids received for the "Chula Vista Golf Course Pedestrian Trail and
Bridge Improvements in the City of Chula Vista, CA (CIP No.. PR318)" project, awazd a base
contract in the amount of $104,000 to Just Construction.
