On December 11, 2012, the City of Chula Vista entered into an agreement with ECOtality to
install, operate, and maintain electric vehicle (EV) charging stations at five municipal sites at no-
cost to the City (Resolution 2012-238). At the Pazkway and Loma Verde Recreation Centers,
ECOtality needs to install its own electrical meter to serve the new chargers. As such, San Diego
Gas & Electric has requested utility easements for the new electrical services.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that this action consisting of
the granting of utility easements to SDG&E to be used in connection with City of Chula Vista
EV charging stations, qualifies for a Class 5 (b) categorical exemption pursuant to Section
15305(b) [Minor Alterations in Land Use Limitati

DISCUSSION
Staff has reviewed the request and concurs that the easements aze necessary to provide electrical
service. Additionally, staff has determined that the proposed easements use is consistent with the
uses dedicated as permissible for this land. While the easements have nominal value, due to the
necessity and benefit to the City's project, staff recommends that the easements be donated to
SDG&E.
DECISION-MAKER CONFLICTS
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundazies of the property which is the subject of this action.
CURRENT YEAR FISCAL IMPACT
There is no direct fiscal impact associated with granting the easements.
ON-GOING FISCAL IMPACT
None.

EASEMENT
THE CITY OF CHULA VISTA, A MUNICIPAL CORPORATION (Grantor), grants to
SAN DIEGO GAS & ELECTRIC COMPANY, a corporation (Grantee), an easement and right of way
in, upon, over, under and across the lands hereinafter described, to erect, construct, change the size of,
improve, reconstruct, relocate, repair, maintain and use facilities consisting of:
1. Underground facilities and appurtenances for the transmission and distribution of
electricity.
2. Communication facilities, and appurtenances.
The above facilities will be installed at such locations and elevations upon, along, over and under
the hereinafter described easement as Grantee may now or hereafter deem convenient or necessary.
Grantee also has the right of ingress and egress, to, from and along this easement in, upon, over and
across the hereinafter described lands. Grantee further has the right, but not the duty to clear and keep
this easement clear from explosives, buildings, structures and materials.
The property in which this easement and right of way is hereby granted is situated in the County
of San Diego, State of California described as follows:
Parcel 1 of Parcel Map No. 4620 filed April 5, 1976 at File No. 76-099347 in the Office of the
County Recorder of said County of San Diego.
The easement in the aforesaid property shall be a strip of land, including all of the area lying
between the exterior sidelines, which sidelines shall be three (3) feet, measured at right angles, on each
exterior side of each and every facility installed, the approximate location being shown and delineated as
"UTILITY FACILITIES" on the Exhibit "A", attached hereto and made a part hereof.

Grantor shall not erect, place or construct, nor permit to be erected, placed or constructed, any
building or other structure, plant any tree, drill or dig any well, within this easement.
Grantor shall not increase or decrease the ground surface elevations within this easement after
installation of Grantee's facilities, without prior written consent of Grantee, which consent shall not
unreasonably be withheld.
Grantor further grants to Grantee the right to assign any or all of the rights granted in this
easement in whole or in part to other companies providing utility or communication facilities/services.
Upon receipt of written request from Grantor, this easement will be quitclaimed by Grantee,
provided that the facilities have been removed.
Grantor will exercise only such reserved rights in said land as will not interfere with or prohibit
the free and complete use and enjoyment by Grantee, its successor or assigns, of the rights hereby
granted. Grantee shall have the right to assign any or all rights granted in this easement in whole or in
part to other companies providing utility or communication services. Grantee shall have the right to top,
cut, remove, or trim interfering plants and trees, and to keep said easement free from and to prevent any
person, including Grantor and successors and assigns, from erecting, placing, or storing on said easement
any flammable or other hazards and any structures, objects, or earth fills/cuts or other obstructions.
CONDUITS CARRY HIGH VOLTAGE ELECTRICAL CONDUCTORS, therefore Grantor
shall not make or allow any excavation or fill to be made within this easement WITHOUT FIRST
NOTIFYING SAN DIEGO GAS & ELECTRIC COMPANY BY CALLING (619) 696-2000, and
OBTAINING PERMISSION.
The legal description for this easement was prepared by San Diego Gas & Electric Company
pursuant to Section 8730 of the Business and Professions Code, State of California.
This easement shall be binding upon and inure to the benefit of successors, heirs, executors,
administrators, permittees, licensees, agents or assigns of Grantor and Grantee.

the center line of the facilities to be installed, the approximate location being shown and delineated as

COMPANY (SDG&E) FOR ELECTRIC FACILITIES AS
NECESSARY TO PROVIDE UTILITY SERVICES FOR

WHEREAS, on December 11.2012, the City of Chula Vista entered into an agreement
with ECOtality to install, operate, and maintain electric vehicle (EV) charging stations at five

WHEREAS, at the Parkway and Loma Verde Recreation Centers, ECOtality needs to

WHEREAS, SDG&E has requested a utility easement for the new electrical services: and
WHEREAS, staff has determined that the proposed easement use is consistent with the
uses dedicated as permissible for this land.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby grant an
easement over City-owned land to SDG&E for electric facilities as necessary to provide utility
services for electric vehicle charging stations.
