Trinity Pacific Investments, LLC (Developer) is in the process of developing a senior
care facility located at 1420 East Palomar Street. The project has a proposed access point
along the eastern portion of their frontage of East Palomar Street where access rights
have been relinquished to the City of Chula Vista. Trinity Pacific Investments, LLC has
also requested that portions of various easements along their frontage of East Palomar
Street be vacated. The portions of those easements are no longer used for their intended
uses and therefore are proposed for vacation.

SUMMARY
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed activity for compliance
with the California Environmental Quality Act (CEQA) and has determined that the
proposed actions consisting of the vacation of easements no longer used for the purpose
for which these were dedicated or acquired as stipulated by State law and said actions
will not result in the creation of any new parcel, qualify for a Class 5 categorical
exemption pursuant to Section 15305 (a) [Minor Alterations in Land Use Limitations] of
the State CEQA Guidelines. Thus, no further environmental review is required.

DISCUSSION
Trinity Pacific, LLC, is proposing to build Saint Paul's Senior Homes and Services
located at 1420 East Palomar Street in Otay Ranch Village One (Attachment 1). It is
proposed to be a multistory 300-bed senior care facility, which will service Independent
and Assisted Living and Memory Care residents. The project will be located on a 4.5-
acre lot at the southeast corner of intersection of East Palomar Street and Santa Andrea
Street.
Driveway Access on East Palomar Street
On June 20, 2000, City Council approved CVT No. 96-04A, Otay Ranch Village 1 "A"
Map No. 2 final map with Resolution No. 2000-208. With the approval of the
subdivision map, the relinquishment of access along the southern right of way of East
Palomar Street was granted to the City of Chula Vista. This was done to allow the City
to maintain control of the amount of driveways that have access to East Palomar Street.
With the development of the St. Paul Senior Homes and Services project, at the southeast
comer of East Palomar Street and Santa Andrea Street, the Developer is proposing access
to their site along East Palomar at a location as shown in.Attachment 2. City staff has
reviewed the proposed location for the access off of East Palomar and has deemed it
acceptable. Therefore, with Council's action tonight, the city will allow Trinity Pacific
Investments, LLC to construct driveway access at the location as depicted in Attachment
2.
Vacation of Easements
On June 24, 1998, the City of Chula Vista approved Final Map No. 13592. With the
approval of the final map, the developer granted to the City of Chula Vista, an assignable
and irrevocable general utility and access easement and a public transportation easement
With the development of the St. Paul Senior Homes project at the southeast corner of
East Palomar Street and Santa Andrea Street, the Developer has requested that the
southerly 7-foot portions of these easements be abandoned per the California Streets and
Highways Code.

Assignable and irrevocable general utility and access easement
The assignable and irrevocable general utility and access easement provides utility
companies to locate any of their necessary facilities outside the City's Right of Way.
City staff has determined that the southerly 7 feet of the assignable and irrevocable access
easement is no longer required and can be vacated because there are no existing utilities
within that portion of the easement. The only utilities located within the easement aze
those of the Otay Water District located within the first 3 feet adjacent to East Palomar
Street. The Otay Water District has notified the City that the reduction in the easement
does not affect their facilities. There aze no other proposed facilities located within the
easement and the southerly 7 feet of the easement can be vacated.
Public Transportation Easement
The Public Transportation Easement's purpose was to reserve the 10 feet along the
southerly right of way of East Palomaz Street for the public transportation facilities such
as transit stops. The easement was needed at the time because generally, transit stops are
located as construction of village progresses and the need arises. St. Paul's Senior
Homes and Services is proposed to be built on the last lot to be developed in Otay Ranch
Village One. All the transit facilities for Otay Ranch Village One have been constructed
and are in use today. Therefore the easement is no longer needed and the southerly 7 feet
of the easement can be vacated.
Part 3 (commencing with Section 8300) of Division 9 of the California Streets and
Highways Code ("Public Streets, Highways, and Service Easements Vacation Law''), at
Chapter 4, provides the authority and procedures for the summazy vacation of public
service easements. Section 8333(a) of the Public Streets, Highways, and Service
Easements Vacation Law specifically allows for summary vacation proceedings when an
easement has not been used for the purpose for which it was dedicated or acquired for
five consecutive years. Accordingly, the City Council may vacate the easements by
adoption of a resolution stating all of the following:
1. That the vacation is made under Chapter 4 of the Public Streets, Highways, and
Service Easements Vacation Law;
2. The name or designation of the easement and a precise description of the portion
vacated (see Attachment 3);
3. The facts under which the vacation is made, and;
4. That from and after the date the resolution is recorded, the easements vacated no
longer constitutes an open space, street, highway, or public service easement.
Both easements were dedicated when Final Map No. 13592 was recorded in the County
Recorder's office on June 24, 1998. No facilities were ever placed in the portion of the
easements proposed to be vacated; thus the portions of the easements meet the
requirements for summary vacation under section 8333(a) of the California Streets and
Highways Code.

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council Members and has found no
property holdings within 500 feet of the boundaries of the property, which is the subject
of this action.
CURRENT YEAR FISCAL IMPACT
Developer is responsible for all costs associated with the authorization of access to East
Palomar Street and the summary vacation of the easements. No fiscal impact.
ONGOING FISCAL IMPACT
No ongoing fiscal impact.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

EAST PALOMAR TO TRINITY PACIFIC INVESTMENTS,
LLC
WHEREAS, Trinity Pacific Investments, LLC (Developer) is proposing to build Saint
Paul's Senior Homes and Services at 1420 East Palomar Street; and
WHEREAS, the Developer has proposed that access to the site be located along East
Falomar Street at a certain location as shown in Exhibit "A" (Driveway Location)
WHEREAS, the City Of Chula Vista was granted the relinquishment of access to East
Palomar Street per Map No. 13990, recorded on June 27, 2000 and allows the City to restrict
access to East Palomar Street; and
WHEREAS, Developer has requested that authorization be granted, by the City Of Chula
Vista, to allow access to East Palomaz Street at the Driveway Location.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
does hereby authorize the Developer access to East Palomar Street at the Driveway Location as
depicted in Exhibit A.

THE ASSIGNABLE AND IRREVOCABLE GENERAL
UTILITY AND ACCESS EASEMENT AND THE PUBLIC
TRANSPORTATION EASEMENT ADJACENT TO EAST
PALOMAR
WHEREAS, Trinity Pacific Investments, LLC has requested the vacation of portions of
certain easements located on the Saint Paul Senior Homes and Services Project Site as described
on Exhibit "A"(Property); and
WHEREAS, an assignable and irrevocable general utility and access easement and the
public transportation easement were granted to the City Of Chula Vista per Map No. 13592
recorded June 24, 1998; and
WHEREAS, Chapter 4, Section 8333(a) of the California Streets and Highways Code
states that the legislative body of a local agency may summarily vacate a public service easement
if the easement has not been used for the purpose for which it was dedicated or acquired for five
consecutive years preceding the proposed vacation; and
WHEREAS, the aforementioned portions of easements have not been used for their
intended purpose for five consecutive years preceding this vacation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
as follows:
That, after considering the evidence submitted, it finds that the portiohs of the various
easements located within the Property site have not been used for their intended purpose
for the past five years and that there are no in-place public utility or public transportation
facilities that are in use and would be affected by the vacation.
2. That, pursuant to Part 3, Chapter 4, section 8333(a) of the California Streets and
Highways Code, entitled "Summary Vacation," it orders the summary vacation of the
portions of the various easements located within the Property, described and depicted in
the attached Exhibit "B".
3. That it directs the City Clerk to cause a certified copy of this Resolution of Vacation,
attested by the Clerk under seal, to be recorded without acknowledgement, certificate of
acknowledgement, or further proof in the Office of the County Recorder. Upon such
recordation, the easements vacated shall no longer constitute public service easements
and such vacations shall be complete.
